تعارف:
لاہور ہائی کورٹ نے اپنے حالیہ فیصلے میں یہ واضح کر دیا ہے کہ جب پنجاب سروس ٹربیونل فعال ہو جائے تو ہائی کورٹ آئینی درخواست کی سماعت جاری نہیں رکھ سکتی۔ یہ فیصلہ محمد سرفراز بنام سیکرٹری اسپیشلائزڈ ہیلتھ کیئر اینڈ میڈیکل ایجوکیشن ڈیپارٹمنٹ کیس میں سنایا گیا، جو سروس معاملات سے متعلق اہم آئینی اور قانونی نکات کا احاطہ کرتا ہے۔
کیس کی مختصر کہانی:
محمد سرفراز، جو ایک سرکاری ملازم ہیں، نے اپنی سروس سے متعلق شکایت کے لیے لاہور ہائی کورٹ سے رجوع کیا۔ اس وقت پنجاب سروس ٹربیونل غیر فعال تھا کیونکہ اس کے چیئرمین یا ممبران کی تقرری نہیں ہوئی تھی۔ ہائی کورٹ نے اس درخواست کو بطور عارضی اقدام سنا تاکہ درخواست گزار انصاف سے محروم نہ رہے۔ تاہم، جب ٹربیونل دوبارہ فعال ہوا، تو عدالت نے اہم قانونی سوال پر غور کیا کہ آیا وہ اس کیس کی مزید سماعت جاری رکھ سکتی ہے یا نہیں۔
عدالتی فیصلہ:
فاضل عدالت نے آئین کے آرٹیکل 212(2) اور پنجاب سروس ٹربیونل ایکٹ 1974 کے سیکشن 8 کو مدنظر رکھتے ہوئے قرار دیا کہ:
سروس معاملات کا اختصاصی فورم صرف سروس ٹربیونل ہے۔
جب ٹربیونل فعال ہو جائے تو ہائی کورٹ کی کارروائی ازخود ختم (abate) ہو جاتی ہے۔
ٹربیونل کی غیر فعالیت کے دوران ہائی کورٹ کا آئینی دائرہ اختیار ایک استثنائی اور عارضی بندوبست ہے۔
یہ عارضی انتظام ہائی کورٹ کو مستقل دائرہ اختیار نہیں دے سکتا اور نہ ہی ٹربیونل کے آئینی اختیارات کو محدود کر سکتا ہے۔
قانونی اہمیت:
یہ فیصلہ سروس قوانین کے نفاذ، دائرہ اختیار کی وضاحت، اور آئینی درخواستوں کے طریقہ کار میں راہنمائی فراہم کرتا ہے۔ عدالت نے یہ اصول طے کیا کہ سروس ٹربیونل کی غیر موجودگی میں ہائی کورٹ کا کردار صرف ایک "خلا پُر کرنے کا انتظام" (Stop-gap arrangement) ہے، جو ٹربیونل کے فعال ہوتے ہی ختم ہو جانا چاہیے۔
نتیجہ:
لاہور ہائی کورٹ کا یہ فیصلہ سروس قوانین کے حوالے سے نہ صرف آئندہ کے لیے رہنما اصول فراہم کرتا ہے بلکہ عدالتی دائرہ اختیار کی حدود کو بھی واضح کرتا ہے۔ اب واضح ہو گیا ہے کہ جیسے ہی پنجاب سروس ٹربیونل فعال ہو، ہائی کورٹ میں زیر سماعت تمام آئینی درخواستیں خود بخود ختم تصور کی جائیں گی۔
The point for determination before this Court is whether the High Court has jurisdiction and/or is obligated to decide the matter after having assumed jurisdiction as a stopgap arrangement due to non-functionality of the Punjab Service Tribunal ("the Tribunal"), upon the Tribunal becoming functional, keeping in view Article 212 of the Constitution of the Islamic Republic of Pakistan, 1973 ("the Constitution"). Held: Article 212(2) of the Constitution read with Section 8 of the Punjab Service Tribunals Act, 1974 clearly envisaged that once the Tribunals are established, all proceedings pending before any Court will abate. The temporary non-functionality of the Tribunal indicates that it is not established and once the Tribunal assumes functioning, the proceedings before this Court will abate. The entertainment of a constitutional petition on account of non-functionality of the Tribunal is an exceptional remedy carved-out to ensure that a civil servant is not left remediless on account of non-appointment of its Chairman and/or members by the Government, however, this does not and should not so operate as to divest the Tribunal of its constitutionally vested jurisdiction and/or, conversely speaking, vest this Court with constitutionally divested jurisdiction. It is a stop-gap arrangement and such arrangement ought to dissipate upon the Tribunal becoming functional.
