ریونیو اتھارٹی کے فیصلے کے خلاف سول عدالت یا ہائی کورٹ؟ سپریم کورٹ کا اہم فیصلہ

سپریم کورٹ نے PLD 2026 Supreme Court 269 میں ریونیو ریکارڈ، سرکاری زمین، الاٹمنٹ اور ریونیو حکام کے فیصلوں سے متعلق اہم قانونی اصول وضع کیے ہیں۔ عدالت نے واضح کیا کہ کسی شخص کی ملکیت کا دعویٰ صرف انتقال یا ریونیو ریکارڈ کی بنیاد پر کامیاب نہیں ہوسکتا، بلکہ ملکیت کی بنیادی دستاویز اور اصل لین دین کو قانون کے مطابق ثابت کرنا ضروری ہے۔

بنیادی الاٹمنٹ ثابت کرنا ضروری ہے

مقدمے میں مدعیان نے متنازعہ زمین کی ملکیت کا دعویٰ کرتے ہوئے مؤقف اختیار کیا کہ انہیں یہ زمین ایک سابقہ الاٹمنٹ کے ذریعے حاصل ہوئی تھی۔ تاہم وہ اس بنیادی الاٹمنٹ کی دستاویز عدالت میں پیش کرکے قانون کے مطابق ثابت نہ کرسکے۔

سپریم کورٹ نے قرار دیا کہ جب دعوے کی بنیاد ہی کسی سابقہ الاٹمنٹ پر ہو تو اس الاٹمنٹ کو ثابت کیے بغیر صرف بعد کے ریونیو اندراجات کی بنیاد پر ملکیت تسلیم نہیں کی جاسکتی۔

صرف انتقال سے ملکیت ثابت نہیں ہوتی

عدالت نے واضح کیا کہ انتقال یا ریونیو ریکارڈ کا اندراج بذاتِ خود ملکیت کا حتمی ثبوت نہیں۔ اگر بنیادی دستاویز ثابت نہ ہو تو محض انتقالات، ریونیو ریکارڈ یا زبانی بیانات کی بنیاد پر ملکیت کا دعویٰ کامیاب نہیں ہوسکتا۔

جرح میں دستاویز کا محض حوالہ کافی نہیں

سپریم کورٹ نے قرار دیا کہ اگر کسی دستاویز کو باقاعدہ طور پر ثبوت میں پیش نہیں کیا گیا تو جرح کے دوران اس کا محض حوالہ دینا اس کے قانونی ثبوت کا متبادل نہیں بن سکتا۔

یعنی کسی دستاویز کا جرح میں ذکر ہوجانا اس بات کے لیے کافی نہیں کہ عدالت اسے ثابت شدہ دستاویز تصور کرے۔

صرف Exhibit کرنے سے دستاویز ثابت نہیں ہوتی

عدالت نے مزید واضح کیا کہ کسی دستاویز کو صرف Exhibit کردینے سے وہ خود بخود قانونی طور پر ثابت شدہ نہیں ہوجاتی۔ دستاویز کو قانونِ شہادت میں مقررہ طریقہ کار کے مطابق ثابت کرنا ضروری ہے۔ اگر اس کے ثبوت کا طریقہ ناقص ہو تو محض Exhibit ہونے کی بنیاد پر اسے قابلِ اعتماد ثبوت قرار نہیں دیا جاسکتا۔

سرکاری زمین کا تحفظ

سپریم کورٹ نے اس امر پر بھی زور دیا کہ عدالتوں کی ذمہ داری ہے کہ وہ سرکاری زمین اور سرکاری املاک کا تحفظ یقینی بنائیں۔ ریونیو ریکارڈ کے اندراجات، مبینہ الاٹمنٹ یا انتقالات کو ناقص ثبوت، قانونی طریقۂ کار کی کوتاہی یا باہمی ملی بھگت کے ذریعے سرکاری زمین کے ناجائز حصول کا ذریعہ نہیں بننے دیا جاسکتا۔

سول عدالت ریونیو حکام کے فیصلے کا دوبارہ مکمل ٹرائل نہیں کرے گی

فیصلے کا ایک اہم اصول یہ ہے کہ جب کسی معاملے کے حقائق مجاز ریونیو اتھارٹی پہلے ہی طے کرچکی ہو تو سول عدالت ہر معاملے میں انہی حقائق کا دوبارہ مکمل ٹرائل شروع نہیں کرسکتی۔

البتہ اگر ریونیو اتھارٹی کا حکم بغیر قانونی اختیار، کسی ثبوت کے بغیر، دائرۂ اختیار کی خرابی یا بدنیتی پر مبنی ہو تو اسے مناسب قانونی طریقے سے چیلنج کیا جاسکتا ہے۔

آرٹیکل 199 کے تحت ہائی کورٹ سے رجوع

سپریم کورٹ نے قرار دیا کہ ریونیو اتھارٹی کے حتمی حکم کو مناسب صورت میں آئین کے آرٹیکل 199 کے تحت ہائی کورٹ کے آئینی اختیار میں چیلنج کیا جاسکتا ہے، بجائے اس کے کہ ہر معاملے میں سول عدالت میں ایک متوازی اور طویل مقدمہ شروع کردیا جائے۔

سپریم کورٹ کا حتمی فیصلہ

سپریم کورٹ نے ہائی کورٹ کا فیصلہ کالعدم قرار دیتے ہوئے اپیلیٹ کورٹ کا فیصلہ بحال کردیا، جس کے نتیجے میں مدعیان کا دعویٰ خارج ہوگیا۔

اہم قانونی اصول

  • بنیادی الاٹمنٹ ثابت کیے بغیر ملکیت ثابت نہیں ہوسکتی۔
  • صرف انتقال یا ریونیو ریکارڈ ملکیت کا حتمی ثبوت نہیں۔
  • جرح میں کسی دستاویز کا محض حوالہ دینا کافی نہیں۔
  • صرف دستاویز کو Exhibit کرنے سے وہ قانونی طور پر ثابت شدہ نہیں ہوجاتی۔
  • سرکاری زمین کے تحفظ کے لیے عدالتوں کو خصوصی احتیاط کرنی چاہیے۔
  • سول عدالت ہر معاملے میں ریونیو حکام کے طے شدہ حقائق کا دوبارہ مکمل ٹرائل نہیں کرسکتی۔
  • ریونیو اتھارٹی کے غیر قانونی یا دائرۂ اختیار سے متجاوز حکم کو مناسب صورت میں آرٹیکل 199 کے تحت ہائی کورٹ میں چیلنج کیا جاسکتا ہے۔

PROVINCE OF PUNJAB through District Officer Revenue / Collector District Bhakkar and 3 others ---Petitioners Versus

ZULFIQAR and 8 others ---Respondents

C.P.I.A. No. 1600-1. of 2014, decided on 20th January, 2026.

(Against Order dated 23.05.2014 passed in C.R. No.247 of 2006 by Lahore High Court, Lahore).

(a) Specific Relief Act (I of 1877)-

Ss. 42 & 54-Qanun-e-Shahadat (10 of 1984), Arts. 72, 117 & 120-Suit for declaration and injunction---Document, proof of Onus to prove-Respondents/plaintiffs claimed to be owners in possession of suit land purchased from an earlier allottee and alleged that subsequently the land could not be allotted to appellants defendants by Settlement authorities-Suit filed by respondents/plaintiffs was decreed by Trial Court in their favour but Lower Appellate Court dismissed the suit---High Court in exercise of revisional jurisdiction set aside judgment and decree passed by Lower Appellate Court and restored that of Trial Court passed in favour of respondents/plaintiffs---Validity---Respondents/plaintiffs sought a declaration of ownership and possession-Such relief could not be granted unless respondents/pl plaintiffs discharged burden proving arged burden of proving primary transaction, namely prior allotment, proving conferment of proprietary rights upon the earlier allottee by hrining on record any document in such respect---When foundational document was not produced, respondents /plaintiffs could not succeed merely on the basis of mutation entries or oral assertions Courts were under a solemn obligation to jealously guard public property and to ensure that entries in revenue record, alleged allotments, or fiscal mutations would not become instruments for unlawful deprivation of State land through defective proof, procedural laxity or collusive conduct Supreme Court set aside judgment and decrée passed by High Court and restored that of Lower Appellate Court, consequently, suit filed by respondents / plaintiffs stood dismissed---Appeal was allowed.

----Art. 72---Documentary evidence---Proof---Reference in cross-examination---When a document which is the foundation of claim of a party is never produced in evidence, such document remains wholly unproved and mere reference (to it) during cross-examination cannot substitute the strict proof required by law.

(c) Qanun-e-Shahadat (10 of 1984)---

Art. 72-Documentary evidence-Exhibit during evidence Effect---Documentary material cannot be treated as legally proved merely because it has been exhibited, particularly where mode of proof remains defective,

(d) Civil Procedure Code (V of 1908)---

----S.9---Civil Court---Jurisdiction---Statutory authorities---Determination of factual controversy-Scope---Civil courts are not to conduct a fresh trial to re-determine factual controversies already adjudicated by statutory authorities, unless order assailed is. shown to be without lawful authority or is hased on no evidence or suffers from jurisdictional defect or is a result of mala fide.. ----S. 172---Constitution of Pakistan, Art.199---Orders passed by revenue authorities---Remedy---Bar to jurisdiction of Civil Courts---Effect-Proper recourse ordinarily is to assail final order of competent revenue authority by invoking Constitutional jurisdiction of High Court, rather than embarking upon a parallel and protracted civil trial.
