دوسری شادی کے بغیر اجازت مقدمہ: فیملی کورٹ یا جوڈیشل مجسٹریٹ؟

پشاور ہائی کورٹ نے ایک اہم فیصلے میں دوسری شادی اور اس کے خلاف فوجداری کارروائی سے متعلق اہم قانونی اصول واضح کیے ہیں۔
بغیر اجازت دوسری شادی پر شوہر کو سزا
مقدمے میں پہلی بیوی نے اپنے شوہر کے خلاف شکایت دائر کی کہ اس نے پہلی شادی برقرار ہونے کے باوجود اس کی رضامندی اور ثالثی کونسل کی اجازت کے بغیر دوسری شادی کی۔
جوڈیشل مجسٹریٹ نے شوہر کو مسلم فیملی لاز آرڈیننس 1961 کی دفعہ 6(5)(b)
کے تحت مجرم قرار دیتے ہوئے دو ماہ قید کی سزا سنائی۔
اپیل میں شوہر بری ہوگیا
شوہر نے مجسٹریٹ کے فیصلے کے خلاف اپیل دائر کی، جسے منظور کرتے ہوئے اسے بری کر دیا گیا۔ پہلی بیوی نے اس بریت کے خلاف پشاور ہائی کورٹ سے رجوع کیا۔
پرائیویٹ شکایت میں بریت کے خلاف خصوصی اجازت ضروری
ہائی کورٹ نے قرار دیا کہ چونکہ مقدمہ پولیس کی ایف آئی آر کے ذریعے نہیں بلکہ پہلی بیوی کی جانب سے دائر کردہ نجی شکایت کے ذریعے شروع ہوا تھا، اس لیے بریت کے خلاف ہائی کورٹ میں اپیل دائر کرنے سے پہلے ضابطۂ فوجداری کی دفعہ 417(2) کے تحت خصوصی اجازت حاصل کرنا ضروری تھا۔
عدالت کے مطابق پہلی بیوی نے ایسی خصوصی اجازت کے لیے درخواست بھی دائر نہیں کی تھی، اس لیے وہ بطورِ حق براہِ راست بریت کے خلاف اپیل نہیں کر سکتی تھی۔
دوسری شادی کا جرم فیملی کورٹ ایکٹ کے شیڈول میں شامل نہیں
ہائی کورٹ نے قرار دیا کہ مسلم فیملی لاز آرڈیننس کی دفعہ 6(5)(b)
کے تحت دوسری شادی سے متعلق جرم ویسٹ پاکستان فیملی کورٹس ایکٹ 1964 کے شیڈول کے حصہ دوم میں شامل نہیں ہے۔
لہٰذا اس جرم کی سماعت فیملی کورٹ کے دائرۂ اختیار میں نہیں آتی۔
مقدمہ جوڈیشل مجسٹریٹ ہی سنے گا
ہائی کورٹ نے قرار دیا کہ چونکہ دفعہ 6(5)
(b)
کا جرم فیملی کورٹس ایکٹ کے مذکورہ شیڈول میں شامل نہیں، اس لیے اس کا مقدمہ عام فوجداری عدالت، یعنی جوڈیشل مجسٹریٹ ہی سن سکتا ہے۔
عدالت نے واضح کیا کہ جوڈیشل مجسٹریٹ کی جانب سے اس مقدمے کا اختیارِ سماعت استعمال کرنا درست تھا اور صرف دائرۂ اختیار کی بنیاد پر اس کارروائی کو ختم نہیں کیا جا سکتا۔
مقدمہ دوبارہ اپیلیٹ عدالت کو بھیج دیا گیا
ہائی کورٹ نے معاملہ اپیلیٹ عدالت کو واپس بھیج دیا تاکہ اپیل کو اصل قانونی اور واقعاتی نکات پر دوبارہ سنا جائے اور merits
پر فیصلہ کیا جائے۔

اس فیصلے سے یہ اصول سامنے آتا ہے کہ مسلم فیملی لاز آرڈیننس کی دفعہ 6(5)
(b)
کے تحت پہلی شادی برقرار ہونے کے دوران بغیر مقررہ اجازت دوسری شادی سے متعلق جرم کا مقدمہ فیملی کورٹ کے بجائے جوڈیشل مجسٹریٹ کے سامنے چلایا جائے گا، کیونکہ یہ جرم فیملی کورٹس ایکٹ کے شیڈول کے حصہ دوم میں شامل نہیں ہے۔

Criminal Appeal No. 1675-P of 2023, decided on 25th June, 2025.
Muslim Family Laws Ordinance (VIII of 1961)-
S.6-Criminal Procedure Code (V of 1898), 5.417(2)-Polygamy Contracting second Nikah during subsistence of marriage-Private complaint filed by first/existing wife---Unlawful act and criminal intent---Jurisdiction---First/existing wife filed private complaint. against her husband that her husband contracted second marriage without her consent and permission of the Arbitration Council---After a trial conducted by the Judicial Magistrate, accused was found guilty of the offence under $.6(5)(b) of the Muslim Family Laws. Ordinance, 1961, and after conviction was sentenced to undergo simple imprisonment for two months-Respondent/accused being aggrieved of the order of conviction and sentence preferred an appeal, which was allowed and respondent was acquitted---Complainant/appellant being dissatisfied with such order of acquittal filed the present appeal---Held: In the present case, the relevant criminal proceedings had admittedly been instituted upon the complaint filed by wife of the accused, the present appellant, without obtaining special leave to appeal from the High Court; therefore, the appellant was legally precluded from instituting the present. appeal before the High Court as a matter of right---No particular application for grant of special leave to appeal had been filed by the appellant in terms of $.417 (2) of Cr.P.C--An independent overview of Part-II of the ibid Schedule read with $.5(2) of the West Pakistan Family Court Act, 1964, manifested that if any offence mentioned in the Schedule was committed by one of the spouses against the other, then the exclusive jurisdiction would lie with the Family Court to try such offences; however, a threadbare perusal of the ibid provisions of law glorified that when the accused had been charged under 5.6(5)(b) of the Muslim Family Laws Ordinance, 1961, which was not part and parcel of Part-II of the Schedule: then, the jurisdiction to try such an offence only laid with the Courts of ordinary criminal jurisdiction, to be tried by the concerned Judicial Magistrate---Meaning thereby that the offences which were not included in Part-II of the Schedule of West Pakistan Family Courts Act, 1964, including S.6(5)(b) of the Muslim Family Laws Ordinance, 1961, shall not be tried by the Family Court--In the present case, the accused/respondent had been charged under $.6(5)(b) of the Muslim Family Laws Ordinance, 1961, which could be tried by the Courts of ordinary criminal jurisdiction; therefore, assumption of jurisdiction and taking cognizance by the Judicial Magistrate was unexceptional, which could not have been been reversed, sed, solely on the point of jurisdiction--Appeal against acquittal was allowed and case was remanded back to the appellate Court to rehear the appeal and decide it upon merits.
