📌 مقدمے کا پس منظر

عبداللہ وغیرہ نے دعویٰ کیا کہ وہ رجسٹرڈ سیل ڈیڈ کے ذریعے جائیداد کے مالک ہیں، لیکن مخالف فریق نے ریونیو حکام سے ملی بھگت کرکے مبینہ طور پر فراڈ کے ذریعے انتقال اپنے نام کروا لیا۔ انہوں نے ملکیت کے اعلان اور مستقل حکمِ امتناعی کے لیے سول کورٹ سے رجوع کیا۔

⚖️ اصل قانونی سوال

کیا ریونیو حکام کی جانب سے پہلے فیصلہ کیے جانے کے بعد فراڈ اور ملکیت (Title) کا تنازع سول کورٹ میں زیرِ سماعت آ سکتا ہے؟

🏛️ سپریم کورٹ کا فیصلہ

سپریم کورٹ نے قرار دیا کہ ریونیو حکام کا اختیار بنیادی طور پر ریونیو ریکارڈ اور اس میں اندراجات کی درستگی تک محدود ہے۔ وہ کسی فریق کی ملکیت کا حتمی فیصلہ یا فراڈ کے پیچیدہ سوالات کا فیصلہ نہیں کر سکتے۔

🔍 فراڈ اور ملکیت کا فیصلہ کون کرے گا؟

اگر کسی انتقال یا ریونیو ریکارڈ کو فراڈ، دھوکہ دہی یا غلط بیانی کی بنیاد پر چیلنج کیا جائے اور ملکیت بھی متنازع ہو تو اس کے لیے شہادت اور مکمل عدالتی جانچ ضروری ہوتی ہے۔ ایسا معاملہ سول کورٹ کے دائرۂ اختیار میں آتا ہے۔

📜 Section 9 CPC کا اہم کردار

سپریم کورٹ نے واضح کیا کہ Section 9 CPC کے تحت سول کورٹ کو ایسے ملکیتی تنازعات سننے کا اختیار حاصل ہے، جب تک قانون نے واضح طور پر اس اختیار کو خارج نہ کیا ہو۔

🚫 Section 172 Land Revenue Act کی حد

West Pakistan Land Revenue Act, 1967 کی Section 172 ہر قسم کے ملکیتی تنازع میں سول کورٹ کا اختیار ختم نہیں کرتی۔ سول کورٹ کا اختیار صرف ان معاملات میں محدود ہوگا جو قانون نے واضح طور پر ریونیو حکام کے لیے مخصوص کیے ہیں۔

✅ اہم قانونی اصول

اگر انتقال یا ریونیو ریکارڈ کو فراڈ کی بنیاد پر چیلنج کیا جائے اور ساتھ ملکیت کا بنیادی تنازع موجود ہو تو سول کورٹ اس معاملے کا حتمی فیصلہ کر سکتی ہے۔

Versus

WARYAM and others ---Respondents

Direct Civil Appeal No. 02-K of 2023, decided on 26th December, 2025.

(On appeal from the order of the High Court of Sindh, Circuit Court, Hyderabad dated 23.12.2022 passed in R.A. No. 70 of 2005).

West Pakistan Land Revenue Act (XVII of 1967)-

-S.172-Civil Procedure Code (V of 1908), S.9-Specific Relief Act (1 of 1877), Ss.42 & 54-Title dispute viz immoveable property Disputed mutation entered on the basis of fraud, challenge to-Revenue hierarchy already deciding the matter--Effect-Jurisdiction of Civil Court-Scope---Appellants filed a suit for it for declaration and permanent injunction claiming ownership of the property through registered sale deed alleging that the respondents in collusion with revenue authorities fraudulently transferred the property in their names through mutation-The Trial Court dismissed the suit on the ground that the matter had already been decided by the revenue hierarchy---The Appellate Court reversed this finding, but the High Court restored the Trial Court's dismissal by holding the suit harred under Section 172 of the West Pakistan Land Revenue Act, 1967-The Supreme Court was seized with the question "whether civil court jurisdiction was barred and whether issues of fraud and title could be adjudicated by revenue authorities---Held: Revenue hierarchy being a quasi-judicial forum had limited jurisdiction of rectification, specifically, regarding record of rights, periodic record or correction of entries in the register of mutations-Their decisions were administrative and tentative in nature, wi which neither determined the title of the parties nor resolved the factum of fraud--However, when an aggrieved person challenged the title or validity of the record or mutation, on the plea of fraud or misrepresentation, such controversy required evidence to prove, which was not within the domain of revenue authorities-For such purpose, the civil court had the ultimate jurisdiction by virtue of Section 9 of C.P.C.---Section 172 of the Act of 1968 did not debar the civil court from adjudicating on fundamental question of ownership and legality of record or mutation assailed particularly on the ground of fraud---The decision of the Civil Court regarding determination of question of title and factum of fraud in the record of rights was therefore, binding upon the revenue hierarchy The jurisdiction of civil courts was barred only in respect of the matter spe specifically provided for in Section 172 of the Act of 1967---The subject matter of the suit and the cause of action disclosed in the plaint did not fall within the ambit of Section 172 of the Act of 1967, therefore, the suit was not barred by the said law---Impugned order of the High Court was set aside---Appeal was allowed, in circumstances.
