مقدمے کا پس منظر

درخواست گزار کے خلاف رقم کی ڈگری جاری ہوئی۔ ڈگری پر عمل درآمد کے دوران عمل درآمدی عدالت نے حکم دیا کہ جب تک درخواست گزار ڈگری کی رقم کے لیے ضمانت فراہم نہیں کرتا، اس کا کمپیوٹرائزڈ قومی شناختی کارڈ 

(CNIC)

بلاک رکھا جائے۔

درخواست گزار نے اس حکم کو ہائی کورٹ میں چیلنج کیا، لیکن ہائی کورٹ نے عمل درآمدی عدالت کا حکم برقرار رکھا۔ معاملہ بعد ازاں سپریم کورٹ پہنچا۔

سپریم کورٹ کے سامنے اہم سوال

سپریم کورٹ کے سامنے بنیادی سوال یہ تھا کہ کیا ضابطہ دیوانی کی دفعہ 51 کے تحت عمل درآمدی عدالت رقم کی ڈگری کی وصولی کے لیے کسی شخص کا قومی شناختی کارڈ بلاک کرنے کا حکم دے سکتی ہے؟

سپریم کورٹ کا فیصلہ

سپریم کورٹ نے قرار دیا کہ موجودہ مقدمہ صرف رقم کی ڈگری سے متعلق تھا اور ایسی ڈگری کی وصولی کے لیے کسی شخص کا شناختی کارڈ بلاک کرنا دفعہ 51 ضابطہ دیوانی کے تحت جائز طریقۂ تنفیذ نہیں۔

شناختی کارڈ بنیادی شہری شناخت ہے

عدالت نے قرار دیا کہ قومی شناختی کارڈ کسی شخص کی بنیادی شہری شناخت کا اہم ذریعہ ہے۔ اسے بلاک کرنے سے شخص کی روزمرہ زندگی اور بنیادی شہری معاملات متاثر ہوسکتے ہیں۔

اس لیے محض رقم کی ڈگری کی وصولی کے لیے کسی شخص کو اس کی بنیادی شہری شناخت سے محروم نہیں کیا جاسکتا۔

عمل درآمدی عدالت کے اختیارات لامحدود نہیں

سپریم کورٹ نے واضح کیا کہ عدالت کو ڈگری پر مؤثر عمل درآمد کے لیے وسیع اختیارات حاصل ہیں، لیکن ان اختیارات کو ایسی حد تک استعمال نہیں کیا جاسکتا جس سے ڈگری دار کی رقم وصول کرنے کے بجائے مقروض کی بنیادی شہری زندگی ہی متاثر ہوجائے۔

بجلی اور پانی کی مثال

سپریم کورٹ نے قرار دیا کہ اگر دفعہ 51 کی اس طرح وسیع تشریح کی جائے تو پھر اسی بنیاد پر عمل درآمدی عدالت مقروض کے گھر یا دفتر کی بجلی، پانی اور دیگر بنیادی سہولیات بند کرنے کا حکم بھی دے سکتی ہے، جو قابلِ قبول نہیں۔

اہم قانونی اصول

اس فیصلے کا بنیادی اصول یہ ہے کہ:

رقم کی ڈگری پر مؤثر عمل درآمد ضرور کیا جاسکتا ہے، لیکن اس مقصد کے لیے مقروض شخص کی بنیادی شہری شناخت یا ضروری زندگی کی سہولیات سے محروم نہیں کیا جاسکتا۔

سپریم کورٹ کا حتمی حکم

سپریم کورٹ نے درخواستِ اجازت کو اپیل میں تبدیل کرکے منظور کرلیا اور شناختی کارڈ بلاک کرنے کا حکم ختم کردیا۔

Civil Procedure Code (V of 1908)---

----S.51---Constitution of Pakistan, Art. 185(3)---Execution of money decree-Blocking of CNIC of judgment debtor, challenge to Powers of Executing Court, scope of---Whether deprivation of civil identity was permissible in execution of a money decree?... Brief facts were that the petitioner, being a judgment debtor under a money decree passed in a summary suit in favour of

wherein the respondent No.1, faced execution proceedings wh wherein the Executing Court ordered the blocking of his Computerized National Identity Card (CNIC) until he furnished surety for the decretal amount; this order was upheld by the High Court in revision, leading the petitioner to approach the Supreme Court by filing of the present petition for leave to appeal---The central issue requiring determination was "whether, in execution of a money decree, the Executing Court possessed lawful jurisdiction under Section 51 of the C.P.C. to direct the blocking of a judgment debtor's CNIC as a mode of execution?"-Held: The decree in the present case was simply a money decree on a summary chapter suit-Such a decree required or made permissible execution by blocking the CNIC of the judgment debtor hy resort to Section 51(e)---One might as well then (for instance) also allow the Executing Court to order the blocking of utilities (such as electricity, water etc.) from the residence or workplace of a judgment debtor for execution of a money decree---While a robust approach could certainly be taken to ensure execution it could not be so muscular (especially in the exercise of a general power of the nature conferred by clause (e) as essentially depriving the judgment debtor of an essential aspect of living---Leave petition was converted into an appeal and allowed, in circumstances.
