⚖️ پس منظرِ مقدمہ

مدعیان نے دعویٰ کیا کہ متنازعہ مکان کے اصل مالک نے اپنی زندگی میں اپنا نصف حصہ زبانی ہبہ کے ذریعے ان کے والد کو منتقل کر دیا تھا، لہٰذا وہ وراثت کے ذریعے جائیداد کے مالک ہیں۔ مدعا علیہان نے اس دعوے سے انکار کیا اور مؤقف اختیار کیا کہ ہبہ ثابت نہیں ہوا اور جائیداد قانونی طور پر فروخت ہو چکی تھی۔ ٹرائل کورٹ اور اپیلٹ کورٹ نے دعویٰ مسترد کر دیا، جس کے بعد معاملہ ہائی کورٹ کے سامنے آیا۔

⚖️ ہائی کورٹ کا فیصلہ

پشاور ہائی کورٹ (مینگورہ بینچ) نے سول ریویژن خارج کرتے ہوئے قرار دیا کہ مدعیان زبانی ہبہ کے قانونی تقاضے معتبر شواہد سے ثابت نہیں کر سکے، اس لیے نچلی عدالتوں کے متفقہ فیصلوں میں مداخلت کی کوئی وجہ موجود نہیں۔

✅ ہائی کورٹ نے قرار دیا کہ زبانی ہبہ ثابت کرنے کا بوجھ دعویٰ کرنے والے (Plaintiff) پر ہوتا ہے، اور اسے مضبوط، قابلِ اعتماد اور براہِ راست شواہد کے ذریعے ہبہ ثابت کرنا ہوتا ہے۔
✅ ہائی کورٹ نے قرار دیا کہ زبانی ہبہ کے لیے ایجاب (Offer)، قبولیت (Acceptance) اور قبضہ (Delivery of Possession) تینوں عناصر کا ثابت ہونا لازمی ہے۔
✅ ہائی کورٹ نے قرار دیا کہ صرف زبانی دعویٰ کافی نہیں، بلکہ ہبہ کی تاریخ، وقت، مقام اور جائیداد کی درست تفصیل بھی اہم ہوتی ہے۔
✅ ہائی کورٹ نے قرار دیا کہ مدعی اپنے مقدمے کی مضبوطی کی بنیاد پر کامیاب ہوتا ہے، نہ کہ مدعا علیہ کی کمزوریوں کی بنیاد پر۔
✅ ہائی کورٹ نے قرار دیا کہ تمام شواہد ریکارڈ ہونے کے بعد کسی مخصوص ایشو کے فریم نہ ہونے کی اہمیت باقی نہیں رہتی، اگر فریقین کو اپنا مؤقف اور شواہد پیش کرنے کا مکمل موقع ملا ہو۔
✅ ہائی کورٹ نے قرار دیا کہ ریویژن میں متفقہ عدالتی نتائج میں صرف اسی صورت مداخلت کی جا سکتی ہے جب واضح قانونی غلطی، شواہد کی غلط پڑھائی یا نظراندازی ثابت ہو۔

📚 نتیجہ

یہ فیصلہ اس اصول کی توثیق کرتا ہے کہ زبانی ہبہ کا دعویٰ محض زبانی بیان سے ثابت نہیں ہوتا۔ دعویٰ کرنے والے کو ہبہ کے تمام قانونی عناصر معتبر شواہد سے ثابت کرنا ہوتے ہیں، بصورتِ دیگر دعویٰ کامیاب نہیں ہو سکتا۔

(6) Specific Relief Act (1 of 1877)-

5.42-Suit for declaration---Claim based on alleged oral gift by original owner in favour of plaintiffs' predecessor-Oral gift Proof-Essential ingredients, proving of Burden of proof-Brief facts were that the petitioners filed a suit for declaration of ownership of a disputed house on the basis of inheritance from their father, claiming that the original owner had gifted his half share to him during his lifetime; the suit was dismissed by the Trial Court, the appeal was also dismissed, and the respondents' cross-objection was partly allowed, whereafter the petitioners filed the present civil revision under S.115, C.P.C.---The issue for determination was whether the concurrent findings of the Courts below on the alleged grul gift and ownership of the house called for interference in revisional jurisdiction?"---Held: Petitioners/plaintiffs failed to establish three essentials of a valid gift through credible, direct and reliable evidence---Even the plaint lacked the specific details such as the date, time, and place of the alleged gift---Petitioners had not even mentioned the correct description of the house, which indicated that, as per the respondents' contention, the petitioners had already old it---The subsequent sale deeds regarding the house were also duly proved by the respondents---Present petition being devoid of merit was dismissed, in circumstances.
