سندھ ہائی کورٹ نے

میں ایک اہم اصول بیان کیا کہ صرف کوآپریٹو ہاؤسنگ سوسائٹی کی رکنیت یا
Provisional Allotment
کسی شخص کو پلاٹ پر قانونی یا ملکیتی حق فراہم نہیں کرتی۔ جب تک حتمی الاٹمنٹ لیٹر اور مخصوص پلاٹ نمبر جاری نہ ہو، کسی شخص کے حق میں نافذ العمل (Vested) حق پیدا نہیں ہوتا۔
📖 مختصر پس منظر
درخواست گزار ایک کوآپریٹو ہاؤسنگ سوسائٹی کے ممبر تھے۔ سوسائٹی نے ابتدا میں 600 مربع گز کے پلاٹس کا منصوبہ بنایا، لیکن بعد میں

منظور کرکے یہ کیٹیگری ختم کر دی۔ درخواست گزاروں نے مؤقف اختیار کیا کہ اس تبدیلی سے ان کے حقوق متاثر ہوئے، لہٰذا انہوں نے سندھ ہائی کورٹ میں آئینی درخواست دائر کر دی۔
عدالت نے ریکارڈ کا جائزہ لینے کے بعد پایا کہ درخواست گزاروں کو نہ حتمی الاٹمنٹ لیٹر جاری ہوا تھا اور نہ ہی کسی مخصوص پلاٹ کا نمبر الاٹ کیا گیا تھا۔ مزید برآں، وہ جنرل باڈی اجلاس میں شریک نہیں ہوئے، قانون میں ان کے لیے مؤثر متبادل فورم بھی موجود تھا، اور انہوں نے دو سال سے زائد تاخیر کے بعد عدالت سے رجوع کیا۔
⚖️ ہائی کورٹ کے اہم قانونی نکات
✅ ہائی کورٹ نے قرار دیا کہ صرف عبوری الاٹمنٹ قانونی حق پیدا نہیں کرتی۔
جب تک کسی رکن کے نام حتمی الاٹمنٹ لیٹر جاری نہ ہو اور کسی مخصوص پلاٹ کا نمبر الاٹ نہ کیا جائے، اس وقت تک اسے پلاٹ پر کوئی نافذالعمل
(Vested)
یا ملکیتی حق حاصل نہیں ہوتا۔
✅ ہائی کورٹ نے قرار دیا کہ متبادل قانونی فورم موجود ہونے پر آئینی درخواست قابلِ سماعت نہیں ہوتی۔
سندھ کوآپریٹو سوسائٹیز ایکٹ، 2020 کے تحت تنازع کے حل کے لیے مکمل قانونی طریقۂ کار موجود تھا، اس لیے درخواست گزاروں کو پہلے اسی فورم سے رجوع کرنا چاہیے تھا۔
✅ ہائی کورٹ نے قرار دیا کہ
AGM
میں شرکت نہ کرنے والا رکن بعد میں اعتراض نہیں کر سکتا۔
اگر کسی رکن کو جنرل باڈی اجلاس میں شرکت اور اپنا مؤقف پیش کرنے کا موقع دیا گیا ہو لیکن وہ شریک نہ ہو، تو بعد میں انہی فیصلوں کو چیلنج کرنے سے وہ
Estoppel
کے اصول کی وجہ سے محروم ہو سکتا ہے۔
✅ ہائی کورٹ نے قرار دیا کہ غیر ضروری تاخیر بھی درخواست کے خلاف جاتی ہے۔
درخواست گزاروں نے نظرثانی شدہ لے آؤٹ پلان کو دو سال سے زائد عرصہ گزرنے کے بعد چیلنج کیا اور تاخیر کی کوئی معقول وجہ پیش نہ کی، اس لیے
Laches
کا اصول بھی ان کے خلاف لاگو ہوا۔
✅ ہائی کورٹ نے قرار دیا کہ آئینی عدالت متنازع حقائق کے تعین کا فورم نہیں۔
جہاں نجی حقوق یا کوآپریٹو سوسائٹی کے اندرونی معاملات سے متعلق متنازع حقائق ہوں اور قانون میں مکمل قانونی طریقہ موجود ہو، وہاں ہائی کورٹ آئینی اختیار کے تحت عموماً مداخلت نہیں کرتی۔
⚖️ نتیجہ
سندھ ہائی کورٹ نے قرار دیا کہ درخواست گزاروں کے حق میں کوئی قانونی یا ملکیتی حق پیدا نہیں ہوا تھا، متبادل قانونی فورم موجود تھا، درخواست غیر ضروری تاخیر سے دائر کی گئی تھی، اور اس لیے آئینی درخواستیں ناقابلِ سماعت قرار دے کر خارج کر دی گئیں۔

یا سوسائٹی کی رکنیت کسی شخص کو پلاٹ پر نافذالعمل حق نہیں دیتی۔ حتمی الاٹمنٹ سے پہلے لے آؤٹ پلان میں تبدیلی کو براہِ راست آئینی درخواست کے ذریعے چیلنج نہیں کیا جا سکتا، خصوصاً جب قانون متبادل فورم فراہم کرتا ہو۔
