غیر قانونی طور پر لائسنس کا اجرا، شفافیت کا فقدان، اور زمین پر ناجائز قبضہ—درخواست گزار 2025 CLC 363تجاوز کار قرار
سندھ ہائیکورٹ کے حالیہ فیصلے (2025 CLC 363) میں ایک اہم معاملہ زیرِ غور آیا جس میں درخواست گزار زیشان یونس کو حکومتِ سندھ کی جانب سے چونا پتھر (Limestone) نکالنے کے لیے لائسنس دیا گیا تھا۔ عدالت کے مطابق اس لائسنس کا اجرا غیر شفاف اور غیر قانونی طریقے سے کیا گیا، کیونکہ اس کے لیے کوئی عوامی نوٹس جاری نہیں کیا گیا اور نہ ہی لائسنس کے اجرا یا اس کی توسیع کا کوئی شفاف طریقہ کار اختیار کیا گیا۔
مدت ختم ہونے کے بعد درخواست گزار نے اپنے طور پر چالان فیس جمع کروا کر زمین پر قبضہ برقرار رکھا، حالانکہ اس کے پاس لائسنس کی مزید توسیع یا منظوری کا کوئی قانونی ثبوت موجود نہیں تھا۔ عدالت نے قرار دیا کہ لائسنس کا اجرا خود قانونی خامیوں سے بھرپور تھا اور اس کی مدت ختم ہونے کے بعد قبضہ برقرار رکھنا غیر قانونی تصرف کے مترادف ہے۔
عدالت نے یہ بھی واضح کیا کہ Easements Act 1882 کے تحت لائسنس محض ایک اجازت ہوتی ہے، یہ کسی کو زمین پر ملکیتی یا مستقل حق نہیں دیتی۔ لائسنس ختم ہونے کے بعد کسی بھی قسم کی سرگرمی یا قبضہ تجاوز (Trespass) کہلاتا ہے۔
فیصلے میں عدالت نے کہا کہ چونکہ لائسنس کے اجرا کا عمل شفافیت سے خالی اور مشکوک تھا، اس لیے اس دوران ملوث سرکاری افسران کے خلاف انکوائری کی جائے تاکہ ذمہ داروں کا تعین ہو سکے۔ مزید برآں، عدالت نے حکم دیا کہ زمین فوری طور پر واگزار کرائی جائے اور درخواست گزار کی غیر قانونی سرگرمیوں کو ختم کیا جائے۔
یہ فیصلہ واضح کرتا ہے کہ سرکاری وسائل یا معدنیات کے لائسنس صرف شفاف، قانونی اور عوامی طریقہ کار کے تحت ہی جاری کیے جا سکتے ہیں۔ کسی بھی غیر قانونی لائسنس یا اس کی بنیاد پر کیا گیا قبضہ قانون کی نظر میں کسی حق یا استحقاق کا حامل نہیں ہوتا۔

----Ss.52 & 62(c)---License/permit to extract limestone---Extension in permit---Obscurity in process of granting license---No public notice---Continued occupation of land without a valid permit---Trespassing---Petitioner continued occupation of the land after expiry of extended period of license/permit by depositing challan/fee on his own without any authority by the respondents---Legality---Validity---Nothing on the record was found as to transparency of process of awarding the permit to extract limestone---It was the primary consideration of the petitioner that a notice ought to have been followed at the time of extending the period of permit/license---Petitioner had been paying challan/fees, on his own, without permission of the authority concerned and had applied for an extension of the license---Petitioner's occupation was illegal and his status was that of a trespasser under the Easements Act, 1882, as permission alone did not bestow any right under the law rather license/permit could have been cancelled even during its subsistence---High Court did not exercise its discretion in favour of the petitioners, who continued to occupy and enjoy the land as trespasser for the extraction of limestone---Occupation over the land was not transparent, thus, High Court ordered an inquiry into the actions of the officials responsible for issuing and renewing the license and also directed to retrieve the land from the trespasser---Constitutional petition was disposed of, in circumstances.
