کیس کی کہانی
ہزار گنجی فروٹ و سبزی مارکیٹ، کوئٹہ کے مشاخورز کو حکومت نے کاروبار کے لیے 23 ایکڑ زمین دی تھی تاکہ وہ اپنا کاروبار منظم طریقے سے کر سکیں۔ شرط یہ تھی کہ زمین صرف مارکیٹ کے مقصد کے لیے استعمال ہو گی۔
لیکن مشاخورز نے یہ زمین دوسروں کو بیچ دی یا کرایہ پر دے دی اور خود آکشن پلیٹ فارم پر غیر قانونی طور پر ڈیرے ڈال کر کاروبار کرنے لگے۔ بعد میں انہوں نے عدالت سے شکایت کی کہ کمیشن ایجنٹس نے زمین پر قبضہ کر رکھا ہے اور وہ صرف 2 ایکڑ پر کاروبار کر رہے ہیں۔
عدالت نے جب ریکارڈ کا جائزہ لیا تو یہ ثابت ہوا کہ اصل قصور وار خود مشاخورز ہیں جنہوں نے زمین کا غلط استعمال کیا۔

ہائی کورٹ نے قرار دیا کہ الاٹ شدہ زمین صرف اسی مقصد کے لیے استعمال کی جا سکتی ہے جس کے لیے وہ دی گئی ہو۔
ہائی کورٹ نے قرار دیا کہ مشاخورز نے زمین خود دوسروں کو بیچی اور کرایہ پر دی، اس لیے وہ ریلیف کے حق دار نہیں رہے۔
ہائی کورٹ نے قرار دیا کہ کوئی بھی شخص دوسرے کی زمین پر قبضہ کر کے کاروبار جاری نہیں رکھ سکتا۔
ہائی کورٹ نے قرار دیا کہ زمین کے غلط استعمال کو عدالت ہرگز برداشت نہیں کرے گی۔
ہائی کورٹ نے قرار دیا کہ آئینی درخواستیں بے بنیاد تھیں، اس لیے خارج کی جاتی ہیں۔

جس نے خود اپنی الاٹ شدہ زمین بیچ دی یا غلط استعمال کیا، وہ بعد میں عدالت سے اپنے حق کے تحفظ کا مطالبہ نہیں کر سکتا۔

سبق
یہ فیصلہ ایک واضح سبق دیتا ہے کہ:
زمین ہمیشہ اسی مقصد کے لیے استعمال ہونی چاہیے جس کے لیے وہ الاٹ کی جائے۔
ناجائز قبضہ یا غلط استعمال پر عدالت کسی فریق کو تحفظ نہیں دیتی۔

Constitutional Petitions Nos. 1926 of 2021 and 307 of 2022, decided on 23rd October, 2023.
Allotment---
----Allotted property being utilized for purposes other than the purpose for which it was allotted---Effect---Petitioners (Mashakhors of Fruit and Vegetable Market, Hazar Ganji, Quetta) filed constitutional petition contending that they (Mashakhors) had been compelled to carry out their business only on two acres of land out of twenty-three (23) acres specified by competent authority for establishment of a venue for the business of fruit and vegetable etc. while the rest of the land was illegally occupied by Commission Agents (Private Respondents)---Validity---Record (furnished by official respondents) revealed that petitioners/Mashakhors were allotted twenty-three (23) acres, but they allegedly sold and rented out their allotted land to others and continued their unwarranted possession on the platform made for fruit and vegetable auction by setting their camps illegally and had utilized the land for purposes other than the purpose for which it was allocated---However, in any case, no person(s) including the petitioners could be allowed to encroach upon the property of others in the garb of their business---High Court did not appreciate such a trend at all---Constitutional petitions, being devoid of merit, were dismissed, in circumstances.
