2025 CLC 785: تھمب امپریشن اور دستخط کے موازنے کی درخواست، اہم قانونی اصول
عدالت عالیہ نے ایک اہم فیصلہ سناتے ہوئے یہ قرار دیا کہ اگر تمام شواہد مکمل ہو چکے ہوں، تب بھی صرف اسی بنیاد پر کسی درخواست کو مسترد نہیں کیا جا سکتا کہ وہ تاخیر سے دائر کی گئی ہے، جب تک کہ قانون میں کوئی وقت کی پابندی نہ ہو۔
اس کیس میں درخواست گزار نے یہ موقف اختیار کیا کہ مخالف فریق کے دستخط اور انگوٹھے کے نشان جعلی ہیں، اس لیے ان کا فرانزک موازنہ ضروری ہے۔ لیکن ماتحت عدالتوں نے یہ کہہ کر درخواست مسترد کر دی کہ چونکہ تمام شواہد مکمل ہو چکے ہیں، اس لیے یہ درخواست قابلِ سماعت نہیں۔
تاہم، عدالت عالیہ نے فیصلہ دیا کہ:
قانونِ شہادت آرڈیننس 1984 کے آرٹیکل 84 میں دستخط یا انگوٹھے کے نشان کے موازنے کے لیے کسی مخصوص وقت کا تعین نہیں کیا گیا۔
محض یہ دلیل کہ درخواست شواہد مکمل ہونے کے بعد دائر کی گئی ہے، اس کی خود کوئی مضبوط قانونی حیثیت نہیں۔
لہٰذا، درخواست گزار کی درخواست کو منظور کیا گیا اور نچلی عدالتوں کے احکامات کو کالعدم قرار دیا گیا۔
قانونی نکتہ:
یہ فیصلہ اس بات کی واضح مثال ہے کہ تکنیکی بنیادوں پر انصاف کے دروازے بند نہیں کیے جا سکتے، خاص طور پر جب قانون میں وقت کی کوئی قید موجود نہ ہو۔

Mere fact that application for comparison of thumb impression had been moved at the stage when the entire evidence has been recorded is not a cogent reason to dismiss the application---In said regard, notably, no time has been stipulated in terms of Art. 84 of the of Qanun-e-Shahadat, 1984, for filing the application for comparison of the signatures and/or thumb impression through expert---High Court set-aide the impugned orders passed by the Courts below, as a consequence, application of the petitioner for conducting comparison of the thumb impression and/or signatures of respondents, was accepted.
