انتظامیہ اور عدلیہ کے دائرہ اختیار کی حدیں: لاہور ہائی کورٹ کا اہم فیصلہ
حالیہ عدالتی فیصلے (2021 CLC 392) میں لاہور ہائی کورٹ نے ایک اہم قانونی نکتہ واضح کیا کہ انتظامیہ کو عدالتی معاملات میں مداخلت کا اختیار حاصل نہیں۔ یہ مقدمہ محمد یعقوب بنام کمشنر لاہور ڈویژن تھا، جس میں عدالت نے اس امر پر غور کیا کہ کیا کمشنر لاہور ڈویژن کا ایک سول تنازعے میں مداخلت کرنا اور تحقیقات کے لیے کمیٹی تشکیل دینا قانونی تھا؟
پس منظر
یہ معاملہ ایک اوورسیز پاکستانی کی شکایت سے شروع ہوا، جس پر کمشنر لاہور ڈویژن نے حکم دیا کہ ایک کمیٹی تشکیل دی جائے جو ریونیو ریکارڈ، رجسٹریشن ریکارڈ، ترقیاتی اداروں کا ریکارڈ، کوآپریٹو ڈیپارٹمنٹ اور ہاؤسنگ سوسائٹی کے ریکارڈ کی جانچ کرے۔ تاہم، یہ معاملہ پہلے ہی عدالت میں زیر سماعت تھا۔
عدالتی فیصلہ
لاہور ہائی کورٹ نے اپنے فیصلے میں قرار دیا کہ:
حکومتی ایجنسیوں کو کسی نجی فرد کے خلاف از خود سول کارروائی کا اختیار نہیں۔
تیسرے فریق کے حقوق کا تعین صرف عدالت کر سکتی ہے، نہ کہ کوئی انتظامی ادارہ جیسے پنجاب اوورسیز پاکستانیز کمیشن۔
کمشنر کا یہ حکم کہ ریکارڈ کی جانچ کی جائے، عدالتی اختیارات میں مداخلت کے مترادف تھا، جو غیر قانونی ہے۔
کمشنر نے اپنے اختیارات سے تجاوز کیا، اس لیے انٹرا کورٹ اپیلز منظور کرتے ہوئے اس کے احکامات کو کالعدم قرار دے دیا گیا۔
قانونی اہمیت
یہ فیصلہ پاکستان کے قانونی نظام میں ایک اہم نظیر کی حیثیت رکھتا ہے کیونکہ اس میں عدلیہ اور انتظامیہ کے درمیان حد بندی کو واضح کیا گیا ہے۔ حکومتی افسران یا ادارے عدالتی اختیارات استعمال نہیں کر سکتے، اور کسی بھی سرکاری محکمے کو یہ حق نہیں کہ وہ عدالت میں زیر سماعت معاملات میں مداخلت کرے۔
نتیجہ
یہ کیس اس اصول کو مضبوط کرتا ہے کہ عدلیہ اور انتظامیہ کے اختیارات الگ الگ ہیں اور عدالتی معاملات میں کسی بھی انتظامی عہدیدار یا ادارے کی مداخلت غیر قانونی ہے۔ اس فیصلے سے اوورسیز پاکستانیوں سمیت تمام شہریوں کو یہ یقین دہانی ملتی ہے کہ ان کے تنازعات صرف عدالت کے ذریعے ہی حل کیے جائیں گے، اور کسی انتظامی افسر کو غیر قانونی مداخلت کی اجازت نہیں ہوگی۔

S.7---Intra Court appeal---Functions of the Commissioner---Interference in judicial functions---Scope---Question before High Court was whether the Commissioner was justified in constituting a committee to visit the site of the plots, thrash out revenue record, registration record, Record/Plan of Development Authority, Cooperative Department Record, Housing Society's Record, etc., when the matter was already under adjudication before the courts of competent jurisdiction---Said order was issued on a complaint from the overseas Pakistani citizen---Validity---Government Agencies on the behest and directive of the Commissioner could not initiate proceedings against private persons by issuing them summonses/notices in order to resolve a civil dispute---Determination of third party rights was unequivocally a judicial function and could only be carried out by a court of law i.e. the judicature, and not by the Punjab overseas Pakistanis Commission or the Government Agencies, which formed executive organs of the State---Order passed by Commissioner regarding thrashing record amounted to interference in judicial proceedings pending in the Courts of law, where the parties were already appearing---Commissioner had transgressed his power/jurisdiction---Intra courts appeals were allowed.
