Rozina Kausar and another v. Arbab Hussain and others

(a) Family Courts Act (XXXV of 1964)---

S. 10(4)---Dissolution of Muslim Marriages Act (VIII of 1939), S. 2-Dissolution of marriage on basis of khula---Conversion to dissolution of on khula ground without of crueltyde considering Non-provision existence of of of cruelty---Validity---Statement maintenance as cruelty---Scope---Family made by the Court petitioner granted (wife/plaintiff) dissolution of presented marriage two different aspects: firstly, she had been subjected to cruelty inasmuch as she was physically abused by the respondent/husband, her gold articles were snatched and she had been deserted for the last three years---Due to these reasons, she had developed acute hatred against the respondent---However, said aspect of cruelty was not considered by the Family Court while granting dissolution of marriage on basis of khula, as contemplated by the proviso to S.10(4) of the West Pakistan Family Courts Act, 1964, and while directing restoration to the husband of the haqmehr received by the wife in consideration of marriage---Though it was the duty of the Judge Family Court to give separate findings on the issue, the Judge Family Court ignored the affidavit given in evidence by the brother of the petitioner/plaintiff as one of her witnesses, alleging acts of maltreatment, non-provision of maintenance allowance and cruelty on the part of the respondent/husband---If said factors were considered and partly appreciated to the extent of the maintenance claim, they reflected that the husband was not taking care of the wife despite being the manager of the house---Husband's role as family manager does not justify domestic violence or "tashaddud", and such conduct is against the injunctions of Islam---Islam gives women the right of access to justice---The right to file a complaint against the husband before the competent authority very clearly and strongly exists in Islam according to the injunctions of Islam---In Islam, a woman can compel her husband by law to fulfil all types of matrimonial obligations, including economic and social obligations, as enunciated in the Holy Quran, including Surah Al-Mujadilah---The term "cruelty" is not confined only to physical assault or infliction of physical injury; rather, being a comprehensive term, as elaborated in S.2 of the Dissolution of Muslim Marriages Act, 1939, it covers a number of grounds for decree of dissolution of marriage and highlights multiple factors on which a woman can obtain divorce or dissolution of marriage-Such grounds cover mental as well as physical cruelty, where the life of the wife has been anguished or her physical or mental health has been endangered---Similarly, S.277 of Muhammadan Law clearly speaks about the obligation of the husband towards his wife, such as "Nafqa", which, in the language of law, signifies all that is necessary to support life, such as food, clothes and lodging---Moreover, when a woman surrenders herself into the custody of her whether she be a Muslim or an infidel as mentioned in the Holy Quran---Therefore, the ground for dissolution of marriage in terms of S.2(ii) of the Dissolution of Muslim Marriages Act, 1939, came into play, namely, that the husband had neglected or had failed to provide for her maintenance for a period of two years---It clearly transpired that the husband was cruel and had not performed his lawful obligation under the Quran and Sunnah---Non-provision of maintenance is itself a form of cruelty, which serves as one of the grounds on which decree of dissolution of marriage can be passed---In the present case, due to cruelty, the petitioner had developed serious aversion and hatred against the respondent, but the Trial Court as well as the Appellate Court had not considered the claim of the petitioner/wife through said lens, where non-maintenance was the primary ground for dissolution of marriage and was liable to be treated as cruelty-All said aspects created a cumulative ground of cruelty, which the Judge Family Court should have taken notice of when the decree for maintenance was passed; therefore, on said ground, the petitioner was entitled to dissolution of marriage on the ground of cruelty---The marriage had already been dissolved and five years had elapsed---Even the respondent had contracted a second marriage, but, till date, by his implied and express conduct, he was not willing to pay maintenance, which itself was sufficient to grant dissolution of marriage to the wife on the ground of cruelty---Various instances of cruel behavior, including non-maintenance, resulted in the development of severe hatred in the mind of the wife-High Court modified the impugned judgments and decrees of the Family Court as well as the Appellate Court, and t, and the dissolution marriage on basis of khula stood converted to dissolution on ground of cruelty with effect from the same date---Constitutional petition, filed by lady plaintiff, was allowed accordingly. it incumbent upon him to supply her clothing and lodging, wheth

(b) Family Courts Act (XXXV of 1964)---

----S. 10(4)---Dissolution of Muslim Marriages Act (VIII of 1939), S.2---Dissolution of marriage on statutory grounds and on basis of khula---Distinction---Principles to be considered by Family Courts before passing decree---Scope---It was necessary to draw a distinction between khula and dissolution of marriage on statutory grounds ---For that purpose, Family Courts should keep in view the following principles before passing a decree/judgment: (i) the Family Courts must pass a decree of dissolution of marriage if cruelty alleged by the wife in her statement is proved, rather than solely on the wife's request for khula; (ii) the grounds mentioned under S.2 of the Dissolution of Muslim Marriages Act, 1939 (DMMA), are distinct from those of khula---When cruelty or any other ground under Section 2 is alleged, the court must dissolve the marriage under that provision rather than on basis of khula, while considering the facts and circumstances of the case; (iii) in cases where dissolution of marriage is based on cruelty or other grounds under S.2 of DMMA, the court must not order the wife to restore haqmehr or any other benefits received at the time of marriage, as such restoration is specific to khula and not to cruelty; (iv) if the husband has failed to maintain the wife, as alleged in her statement, the court must decree maintenance for the wife for the entire period she was not maintained, including the Iddat period; (v) if the Family Court, after concluding pre-trial proceedings under S.10 of the Family Courts Act, 1964, comes to the conclusion that the wife has not been maintained and passes a decree of dissolution forthwith based on khula and also passes an order for maintenance, then such order of maintenance itself implies that cruelty is proved---Therefore, the Family Court is bound to give effect to the judgment of khula by converting it to one based on cruelty from the date when the wife recorded her statement before the Family Court; (vi) the Family Court can pass a decree of dissolution of marriage on basis of khula only after recording the statement following reconciliation, or, in case of failure, in accordance with the proviso to S.10 of the Act---However, if no claim of past maintenance was raised by the wife in connected proceedings or in the same suit, but the Family Court otherwise comes to the conclusion that maintenance to the wife was never paid and the husband defaulted in fulfilling his obligations towards his wife, then, in such eventuality, the ground raised in terms of S.2 of the Dissolution of Muslim Marriages Act, 1939 stands proved---Resultantly, a simple decree of dissolution of marriage on basis of khula could not be passed.
