⚖️ خاندانی مقدمے میں وارنٹ گرفتاری جاری ہونے کے بعد اپیل کا حق

🔹 ایک خاندانی مقدمے میں ڈگری کے نفاذ کے دوران ایک دلچسپ قانونی صورتحال پیدا ہوئی۔ ڈگری دار شخص کے گرفتاری کے وارنٹ کی تعمیل نہ ہونے پر عدالتِ عمل درآمد نے اس کے بھائی، جو اس کا وکیل بھی تھا، کے گرفتاری کے وارنٹ جاری کردیئے۔

🔹 مذکورہ شخص کا مؤقف تھا کہ وہ خود ڈگری دار نہیں تھا اور نہ ہی اس نے اپنے بھائی کے لیے کسی قسم کی ضمانت یا ذمہ داری قبول کی تھی، اس لیے اس کے خلاف گرفتاری کے وارنٹ جاری کرنا درست نہیں تھا۔

⚖️ گرفتاری کے وارنٹ منسوخ کرانے کی درخواست

🔹 وارنٹ جاری ہونے کے بعد مذکورہ شخص نے عدالتِ عمل درآمد کے سامنے گرفتاری کے وارنٹ منسوخ کرنے کے لیے درخواست دائر کی۔

🔹 عدالتِ عمل درآمد نے اس درخواست کو مسترد کردیا اور بعد میں اسے ناقابلِ ضمانت وارنٹ کے ذریعے عدالت میں پیش ہونے کے لیے طلب کیا گیا۔

🔹 اس فیصلے کے خلاف اس شخص نے لاہور ہائیکورٹ سے رجوع کیا اور مؤقف اختیار کیا کہ چونکہ وہ ڈگری کا ذمہ دار شخص نہیں تھا، اس لیے اس کے خلاف کارروائی مناسب نہیں تھی۔

⚖️ اعتراض کی درخواست پر دیا گیا فیصلہ حتمی نوعیت کا تھا

🔹 لاہور ہائیکورٹ نے معاملے کا جائزہ لیتے ہوئے قرار دیا کہ یہ محض ایسا معاملہ نہیں تھا جس میں عدالت نے صرف عبوری طور پر گرفتاری کے وارنٹ جاری کیے ہوں۔

🔹 عدالتِ عمل درآمد نے وارنٹ منسوخ کرنے کی درخواست کو باقاعدہ غور کے بعد مسترد کیا تھا اور اپنے پہلے حکم کو واپس لینے سے انکار کیا تھا۔

🔹 اس لیے عدالتِ عالیہ نے قرار دیا کہ مذکورہ حکم ایک درخواست یا اعتراض پر دیا گیا حتمی فیصلہ تصور ہوگا۔

⚖️ ایسے فیصلے کے خلاف اپیل کا حق موجود ہے

🔹 لاہور ہائیکورٹ نے قرار دیا کہ چونکہ یہ فیصلہ حتمی نوعیت کا تھا، اس لیے خاندانی عدالتوں کے قانون کے تحت اس کے خلاف متعلقہ اپیلی عدالت سے رجوع کیا جاسکتا تھا۔

🔹 عدالت نے اس اصول کے لیے پہلے دیے گئے عدالتی فیصلوں کا بھی حوالہ دیا، جن میں اعتراض کی درخواست مسترد ہونے کو قابلِ اپیل حکم قرار دیا گیا تھا۔

🔹 عدالت نے یہ بھی واضح کیا کہ آیا اس شخص کا معاملہ پہلے بیان کیے گئے عدالتی فیصلے سے مختلف ہے یا نہیں، اس سوال کو اپیلی عدالت مناسب طور پر دیکھ سکتی ہے۔

⚖️ براہِ راست آئینی درخواست قبل از وقت قرار

🔹 لاہور ہائیکورٹ نے قرار دیا کہ جب قانون میں اپیل کا مؤثر متبادل راستہ موجود ہو تو پہلے اسی قانونی راستے کو اختیار کرنا چاہیے۔

🔹 چونکہ درخواست گزار کے لیے اپیل کا راستہ دستیاب تھا، اس لیے آئینی درخواست کو قبل از وقت اور ناقابلِ سماعت قرار دے کر خارج کردیا گیا۔

🔹 تاہم عدالت نے درخواست گزار کو اجازت دی کہ وہ اپنے معاملے کے ازالے کے لیے متعلقہ مناسب فورم سے رجوع کرسکتا ہے۔

📌 اہم قانونی اصول

⚖️ لاہور ہائیکورٹ نے قرار دیا کہ اعتراض کی درخواست پر غور کے بعد دیا گیا حتمی فیصلہ قابلِ اپیل ہوسکتا ہے۔

⚖️ لاہور ہائیکورٹ نے قرار دیا کہ ایسے معاملے میں جہاں قانون متبادل اپیل کا راستہ فراہم کرتا ہو، وہاں براہِ راست آئینی درخواست قابلِ سماعت نہیں رہتی۔

⚖️ لاہور ہائیکورٹ نے قرار دیا کہ کسی شخص کے خلاف گرفتاری کے وارنٹ کے معاملے میں اس کے اعتراض اور اس سے متعلق قانونی نکات کو مناسب طور پر اپیلی عدالت کے سامنے اٹھایا جاسکتا ہے۔

Through this constitutional petition, the petitioner, who is the brother and was attorney of the judgment debtor (Ghulam Murtaza) in the family suit filed by Respondent Nos. 2 to 5/decree holders, has called in question orders dated 21.10.2020 and 09.12.2020 respectively, whereby due to non-service of warrants of arrest of the judgment debtor, at the request of the decree holders/respondents, warrants of arrest of the present petitioner in execution proceedings of decree passed by the Judge Family Court have been issued and the application of the petitioner for cancellation of warrants of arrest against him has been dismissed and he has been summoned through non-bailable warrants to appear in said Court on 04.01.2021.
2. It is contended by the learned counsel for the petitioner that as the petitioner was neither a judgment debtor nor stood as surety or guarantor for him, therefore, issuance of warrants of his arrest, initiating recovery proceedings against him were not justified.

It is observed that it is not a case wherein warrants of arrest have been simplicitor issued against the petitioner for this Court to treat the same as an interlocutory order to look into its legality rather in the present case vide impugned order dated 09.12.2020 the learned executing Court while dismissing the petitioner’s application for cancellation of warrants of arrest, issued against him, has refused to recall its earlier order dated 21.10.2020 by application of its mind to the facts of the matter pending before it and placing reliance on judgment of the Supreme Court reported as Muhammad Pervez vs. Mst. Nabila Yasmeen and 2 others (2004 SCMR 1352), which in the opinion of this Court is a “decision given” on the afore referred application/objection petition of the petitioner against execution of decree, hence, amounts to a final decision, therefore, the said order is appealable before the appellate Court in terms of Section 14 of the
Family Courts Act, 1964. Reliance in this behalf may also be placed on the judgment reported as Rahim Bukhsh vs. Mst. Shehzadi and others (2018 CLC 1789), wherein it has been held that dismissal of an objection petition is an appealable order.
4. As regards the question whether the facts of the petitioner’s case are distinguishable from the facts in the afore referred reported case (2004 SCMR 1352) is concerned, the same can be taken into consideration by the appellate Court, in case any appeal is filed before it.
5. For what has been discussed above, in view of availability of alternate remedy, this petition is dismissed as premature and not maintainable. However, the petitioner, if advised, is at liberty to approach the appropriate forum for redress of his grievance.
