سول نظرثانی میں تاخیر: ہر دن کی تاخیر کی وجہ بتانا ضروری ہے

⚖️ لاہور ہائی کورٹ نے قرار دیا کہ سول نظرثانی درخواست مقررہ مدت کے بعد دائر کی جائے تو تاخیر معاف کرانے کے لیے درخواست گزار کو قابلِ قبول اور کافی وجہ ثابت کرنا ضروری ہے۔ محض ناانصافی، مشکل یا لاعلمی کا عذر کافی نہیں ہوتا۔

🔹 مقدمے کا پس منظر

درخواست گزاروں نے سول نظرثانی کی درخواست دائر کی، تاہم یہ درخواست مقررہ مدت کے مقابلے میں 21 دن کی تاخیر سے دائر ہوئی۔ درخواست گزاروں کی جانب سے اس تاخیر کو معاف کرنے کی استدعا کی گئی۔

عدالت کے سامنے بنیادی سوال یہ تھا کہ کیا درخواست گزار تاخیر کی ایسی معقول وجہ پیش کر سکے ہیں جس کی بنیاد پر قانونِ میعاد کے تحت تاخیر معاف کی جا سکے؟

🔹 تاخیر معافی کا قانونی اصول

⚖️ لاہور ہائی کورٹ نے قرار دیا کہ قانونِ میعاد محض ایک فنی کارروائی نہیں بلکہ اس کے نتیجے میں دوسرے فریق کے حق میں قانونی حق پیدا ہو سکتا ہے۔ اس لیے مقررہ مدت گزرنے کے بعد پیدا ہونے والے حق کو بغیر کافی قانونی جواز کے ختم نہیں کیا جا سکتا۔

عدالت نے واضح کیا کہ تاخیر معافی کے لیے درخواست گزار کو یہ ثابت کرنا ہوتا ہے کہ تاخیر کسی ایسی وجہ سے ہوئی جو اس کے قابو سے باہر تھی۔

🔹 ہر دن کی تاخیر کی وضاحت ضروری

⚖️ لاہور ہائی کورٹ نے قرار دیا کہ مقررہ مدت کے بعد عدالت سے رجوع کرنے والے فریق کو تاخیر کے ہر دن کی مناسب وضاحت اور حساب دینا ہوتا ہے۔

اگر فریق یہ ثابت نہ کر سکے کہ وہ مقررہ مدت میں عدالت سے رجوع کیوں نہیں کر سکا اور تاخیر کی وجہ اس کے اختیار سے باہر تھی تو عدالت کے پاس تاخیر معاف کرنے کے لیے مناسب بنیاد موجود نہیں رہتی۔

🔹 غفلت کرنے والے فریق کو رعایت نہیں

⚖️ لاہور ہائی کورٹ نے قرار دیا کہ قانونِ میعاد ایسے شخص کو تحفظ دینے کے لیے نظر انداز نہیں کیا جا سکتا جو اپنے حقوق کے تحفظ کے لیے بروقت کارروائی کرنے کے بجائے غفلت کا مظاہرہ کرتا رہا۔

عدالت نے قرار دیا کہ صرف ناانصافی، مشکلات یا قانون سے لاعلمی کا دعویٰ اس وقت مؤثر نہیں ہوتا جب تاخیر کی ہر دن کے حوالے سے قابلِ قبول وجہ موجود نہ ہو۔

🔹 فیصلہ

موجودہ مقدمے میں درخواست گزار تاخیر کی معافی کے لیے کوئی قابلِ قبول اور کافی وجہ ثابت نہ کر سکے۔ لہٰذا عدالت نے تاخیر معافی کی درخواست مسترد کر دی اور سول نظرثانی کی درخواست بھی مدتِ معیاد گزر جانے کی وجہ سے خارج کر دی۔

⚖️ اہم قانونی اصول

عدالت نے واضح کیا کہ مقررہ مدت میں قانونی حق استعمال نہ کرنے والے فریق کو بعد میں محض ہمدردی، مشکل یا ناانصافی کے عمومی دعوے کی بنیاد پر رعایت نہیں دی جا سکتی۔ تاخیر معافی کے لیے کافی وجہ اور تاخیر کے ہر دن کی مناسب وضاحت ضروری ہے۔

Civil Procedure Code (V of 1908)---

lowever, -S.115---Limitation Act (IX of 1908), 5.5 & First Schedule, Art.162-A-Civil revision, filing of---Limitation---Conduct, behaviour and negligence of party---Effect-Condonation of delay---Revisional powers/jurisdiction of the High Court-Scope-Sufficient cause, absence of-Effect---Civil revision before the High Court was filed with the delay of 21 days-In the present matter at the time of filing of instant Civil Revision, the period for instituting a revision petition was only governed by 5.115, C.P.C., which prescribed a limitation period of 90 days from the date of the impugned order, judgment or decree---Notably, the provisions of S.S of the Limitation Act were inapplicable to such proceedings, thereby precluding the condonation of delay in filing civil revisions-However, pursuant to a legislative amendment to the First Schedule of the Act (Article 162-A) dealing with limitation period for filing a civil revision under S.115, C.P.C., now S.5 of the Limitation Act extends to extends to civil revisions as well, enabling Courts to condone delays but subject to sufficient cause shown by the party seeking condonation---It is incumbent upon the party seeking such indulgence to establish justifiable grounds warranting the exercise of discretion under 5.5 of the Limitation Act---Question of limitation being not a mere technicality cannot be taken lightly and rights accrued to other party due to limitation cannot be snatched away without sufficient cause and lawful justification which is missing in the case in hand---Limitation would run even against void orders affecting rights of any person--Undeniably, for seeking condonation of delay in filing a revision petition, each and every day consumed for approaching this / High Court beyond the period of limitation has to be explained by the litigant and it also has to be established that delay had been caused due to the reasons beyond his control, but situation was otherwise in the present case---The door of justice is closed after the prescribed period of limitation has elapsed and no plea of injustice, hardship or ignorance could be of any avail unless the delay of each day was properly explained and accounted for-Law of limitation cannot be bypassed to rescue an indolent person who remained sleeping over infringement of his rights-Not an iota of supporting factor in favour of petitioners for condonation of delay in filing this Civil Revision was found---The role of Court is of a and Court cannot come rescue of persons who failed to highlight any sufficient cause for filing the case with delay--Application seeking condonation of delay in filing present Civil Revision being meritless stood dismissed---Civil Revision, being time barred, was dismissed, in circumstances.
