📌 مقدمے کا پس منظر
محکمہ
Excise & Taxation Motor Vehicle Registration Authority
نے درخواست گزار کی گاڑی کے چیسز نمبر کو مشکوک قرار دیتے ہوئے گاڑی ضبط کرنے کا حکم دیا۔
درخواست گزار نے اس حکم کے خلاف قانونی چارہ جوئی کی۔ معاملہ پہلے اپیل اور بعد ازاں
Director General
کے سامنے نظرِ ثانی میں پہنچا، جہاں گاڑی ضبط کرنے کا حکم ختم کر دیا۔
بعد میں اسی

نے اپنے ہی

کو واپس لے لیا۔ درخواست گزار نے اس اقدام کو اسلام آباد ہائی کورٹ میں چیلنج کر دیا۔
⚖️ ہائی کورٹ کا فیصلہ
ہائی کورٹ نے قرار دیا کہ کسی اتھارٹی کے اختیار کا تعین اس بات سے ہوتا ہے کہ اس نے فیصلہ انتظامی حیثیت سے کیا یا عدالتی/نیم عدالتی حیثیت سے۔
🔹 انتظامی حکم اور دفعہ 21
عدالت نے واضح کیا کہ
General Clauses Act, 1897
کی دفعہ 21 کے تحت کسی انتظامی یا
executive authority
کو بعض حالات میں اپنے جاری کردہ حکم کو تبدیل یا واپس لینے کا اختیار حاصل ہو سکتا ہے۔
یعنی انتظامی نوعیت کے احکامات میں اتھارٹی کا اختیار ہمیشہ ختم نہیں ہو جاتا۔
🔹 عدالتی یا نیم عدالتی حکم
اس کے برعکس، جب کوئی قانونی اتھارٹی فریقین کو سننے کے بعد ان کے حقوق اور ذمہ داریوں کا فیصلہ کرتی ہے تو اس کا فیصلہ
judicial یا quasi-judicial order
بن جاتا ہے۔
ایسا فیصلہ صادر کرنے کے بعد اتھارٹی
functus officio
ہو جاتی ہے۔
🔹 اپنے ہی فیصلے کو
Recall
نہیں کیا جا سکتا
ہائی کورٹ نے قرار دیا کہ اگر قانون کسی اتھارٹی کو واضح طور پر
review یا recall
کا اختیار نہیں دیتا تو وہ اپنے ہی عدالتی یا نیم عدالتی فیصلے کو بعد میں واپس نہیں لے سکتی۔
ایسا کرنا فیصلے کی حتمیت کے اصول کے خلاف ہوگا۔
🔹 اپیل اور نظرِ ثانی کا قانونی طریقہ
عدالت نے اس بات کو بھی اہم قرار دیا کہ قانون میں اصل حکم کے خلاف اپیل اور
revision
کے فورمز موجود تھے۔
اس سے ظاہر ہوتا ہے کہ مقننہ نے فیصلے کو مقررہ قانونی فورمز کے ذریعے چیلنج کرنے کا طریقہ مقرر کیا ہے، نہ کہ اسی اتھارٹی کو اپنے فیصلے پر دوبارہ غور کرنے کا اختیار دیا ہے۔
🔹 Jurisdiction قانون سے ملتی ہے
آئین کے آرٹیکل 175(2) کے تحت کوئی عدالت یا اتھارٹی ایسا اختیار استعمال نہیں کر سکتی جو اسے آئین یا قانون نے عطا نہ کیا ہو۔
کسی اتھارٹی کو اختیار فریقین کی رضامندی یا خاموشی سے حاصل نہیں ہو سکتا۔
⚖️ اہم قانونی اصول
ہائی کورٹ نے قرار دیا کہ:
🔹 انتظامی یا
executive
حکم کو مناسب حالات میں دفعہ 21 جنرل کلازز ایکٹ کے تحت واپس یا تبدیل کیا جا سکتا ہے۔
🔹 عدالتی یا نیم عدالتی حکم جاری کرنے کے بعد متعلقہ اتھارٹی functus officio
ہو جاتی ہے۔
🔹 واضح قانونی اختیار کے بغیر کوئی اتھارٹی اپنے ہی judicial
یا
quasi-judicial order
کو
recall یا review
نہیں کر سکتی۔
🔹 عدالتی فیصلوں کی حتمیت
administration of justice
کا بنیادی اصول ہے۔

revision یا review
کا اختیار صرف اسی صورت میں استعمال کیا جا سکتا ہے جب قانون اس کا اختیار فراہم کرے۔

EXCISE AND TAXATION MOTOR VEHICLE REGISTRATION AUTHORITY and others ---Respondents
(a) General Clauses Act (X of 1897)---
S. 21---Provincial Motor Vehicles Ordinance (XIX of 1965), Ss.35, 43 & 115---Islamabad Capital Territory (Seizure and Disposal of Motor Vehicles) Rules, 2014, Rr. 2, 3, 7 & 8---Islamabad Capital Territory (Administration) Order, 1980 (P.O. No. 18 of 1980), Art.2---Vehicle ownership transfer---Suspicious chassis number---Confiscation of vehicle---Confiscation order set aside in revision---Recall of revisional order by same authority-Review/recall jurisdiction in absence of express statutory power-Whether the Director General, having exercised revisional jurisdiction, could lawfully review/recall his own order in the absence of an express statutory power by invoking S.21 of the General Clauses Act, 18977-Held: If the order was administrative or executive, the authority issuing it could ordinarily exercise the power of modification or recall under $.21 of the General Clauses Act, 1897, subject to the conditions prescribed by statute---Conversely, where the order was judicial or quasi-judicial and determined the rights and liabilities of the parties after an arties after an adjudicatory process, the authority became functus officio upon pronouncing ancing the order and such an order could not be recalled or modified--Order of Motor Registration Authority was first subject to scrutiny before the Director in appeal and thereafter open to examination by the Director General in revision-This hierarchy of remedies indicated the legislative intent to subject the original order to judicial scrutiny through designated forums rather than permitting its reconsideration by the same authority which passed it---Presence of the said remedies under the law strongly indicated that the order passed by the Motor Registration Authority was administrative but petition and recalling Geneffectively used judicial in nature---By entertaining the review the revisional order, the Director General effectively assumed jurisdiction not vested in him by law... Impugned order was aside--Constitutional petition was allowed, in circumstances.
(b) General Clauses Act (X of 1897).
S.21-Recall of administrative or executive order in absence of express statutory power-Power to modify or withdraw order. when implied---Scope---Authority which is competent to issue an order in the first instance ordinarily retains the incidental power to modify or withdraw the same, unless a contrary intention appears from the statute conferring such power---Administrative or executive powers are often continuing in nature, and the authority exercising such powers must retain the flexibility to modify or rescind its decisions in order to regulate public administration effectively-Principle of res judicata would not be applicable in cases where an administrative or executive order is sought to be modified or re-adjudicated upon.
(c) General Clauses Act (X of 1897)---
---S.21---Recall of judicial or quasi-judicial order---Judicial/quasi-judicial orders distinct from administrative/executive orders for purposes of recall---Functus officio---Effect---When a statutory authority exercises adjudicatory power and determines rights of parties after hearing them, the resulting decision acquires the character of a judicial or quasi-judicial determination---In such circumstances, the authority rendering the decision becomes functus officio upon pronouncing the order, and the matter cannot thereafter be reopened except in the manner provided by the statute, such as through a power of review, appeal or revision expressly conferred by law. conferred by lav
