بورڈ آف ریونیو نے قرار دیا کہ سول عدالت کی ڈگری کی بنیاد پر منظور ہونے والے انتقال

 کو ریونیو افسران صرف "غلطی" قرار دے کر منسوخ نہیں کر سکتے۔

بورڈ آف ریونیو نے قرار دیا کہ پنجاب لینڈ ریونیو ایکٹ، 1967 کی دفعہ 53 کے تحت ریونیو حکام سول عدالت کے فیصلوں کو ریونیو ریکارڈ میں نافذ کرنے کے پابند ہیں، انہیں ان فیصلوں کا جائزہ لینے، کالعدم قرار دینے یا نظرثانی کرنے کا اختیار حاصل نہیں۔

بورڈ آف ریونیو نے قرار دیا کہ ریونیو اتھارٹیز سول عدالت کے اوپر اپیل یا نگرانی کا فورم نہیں بلکہ صرف سول عدالت کے طے شدہ حقوق کو ریونیو ریکارڈ میں درج کرنے کی ذمہ دار ہیں۔

بورڈ آف ریونیو نے قرار دیا کہ اگر کسی شخص کو سول عدالت کی ڈگری جعلی، دھوکہ دہی پر مبنی یا غیر قانونی معلوم ہوتی ہے تو اس کا واحد مؤثر علاج مجاز سول عدالت سے رجوع کرنا ہے، نہ کہ ریونیو حکام سے۔

بورڈ آف ریونیو نے قرار دیا کہ دھوکہ دہی 

(Fraud)،

 ملکیت (Title)، 

جنرل پاور آف اٹارنی کی قانونی حیثیت، یا سول ڈگری کی صحت جیسے پیچیدہ معاملات ریونیو عدالتوں کے دائرۂ اختیار سے باہر ہیں۔

بورڈ آف ریونیو نے قرار دیا کہ ریونیو عدالتیں 

Summary Jurisdiction 

رکھتی ہیں، اس لیے وہ شہادت ریکارڈ کر کے پیچیدہ سول تنازعات کا فیصلہ نہیں کر سکتیں۔

بورڈ آف ریونیو نے قرار دیا کہ ڈسٹرکٹ کلکٹر صرف انہی ریونیو اندراجات کی اصلاح کر سکتا ہے جہاں غلطی یا بے ضابطگی ریکارڈ سے واضح، ظاہر اور پہلے سے قانونی طور پر ثابت ہو۔

بورڈ آف ریونیو نے قرار دیا کہ اگر معاملہ تفصیلی شہادت، گواہوں اور قانونی جانچ کا متقاضی ہو تو ریونیو حکام کا اختیار ختم ہو جاتا ہے۔

بورڈ آف ریونیو نے قرار دیا کہ کئی سال تک خاموش رہنے والا شخص بعد ازاں پرانے انتقالات کو ریونیو فورم پر چیلنج کرنے کا حق کھو دیتا ہے، کیونکہ ایسے حالات میں Acquiescence 

اور Estoppel 

کے اصول لاگو ہوتے ہیں۔

بورڈ آف ریونیو نے قرار دیا کہ ایک دہائی سے زائد عرصہ خاموش رہنے کے بعد ریونیو حکام کے سامنے اعتراض اٹھانا قانوناً قابل قبول نہیں۔

بورڈ آف ریونیو نے قرار دیا کہ اگر کوئی شخص خود سول عدالت کی ڈگری پر عملدرآمد

 (Execution)

 کا مطالبہ کرے تو بعد میں اسی ڈگری کو "کالعدم" قرار دینے کا مؤقف قانونی تضاد

 (Contradiction) 

شمار ہوگا۔

بورڈ آف ریونیو نے قرار دیا کہ رجسٹرڈ جنرل پاور آف اٹارنی اور اس کی بنیاد پر حاصل شدہ سول عدالت کی ڈگری کو صرف مجاز سول عدالت ہی چیلنج کر سکتی ہے۔

بورڈ آف ریونیو نے قرار دیا کہ ریونیو حکام رجسٹرڈ جنرل پاور آف اٹارنی یا سول عدالت کے فیصلے کی قانونی حیثیت کا ازسرِنو جائزہ لینے کے مجاز نہیں۔

بورڈ آف ریونیو نے قرار دیا کہ مقررہ مدت

 (Limitation) 

گزر جانے کے بعد ریونیو فورم پر دائر درخواست قابل قبول نہیں، خصوصاً جب معاملہ ملکیت اور فراڈ جیسے متنازع سوالات پر مشتمل ہو۔

نتیجہ

بورڈ آف ریونیو پنجاب نے نظرثانی کی درخواست منظور کرتے ہوئے ممبر بورڈ آف ریونیو کا سابقہ فیصلہ کالعدم قرار دیا، ایڈیشنل کمشنر (ریونیو) لاہور کا فیصلہ بحال کیا، اور قرار دیا کہ اگر فریقین سول عدالت کی ڈگری یا اس کی بنیاد پر ہونے والے انتقال کو چیلنج کرنا چاہتے ہیں تو انہیں مجاز سول عدالت سے رجوع کرنا ہوگا، کیونکہ ریونیو حکام ایسے معاملات کا فیصلہ کرنے کا اختیار نہیں رکھتے۔

(a) Punjab Land Revenue Act (XVII of 1967)---

----S.53---Specific Relief Act (1 of 1877), S.42---Mutation entries based on civil court decree, challenge to Revenue authoritiet, powers of---Civil court decree, implementation of-Challenge after decades---Doctrines of acquiescence and estoppel-Scope-Revenue officers are under a binding obligation to reflect civil court decreas in the revenue record and possess no jurisdiction to question, review or override them under the mandate of S. 53 of the Punjab Land Revenue Act, 1967---The revenue hierarchy acts in execution of civil rights determined by the civil court and cannot function as e parallel appellate or supervisory body---It is legally untenable that a mutation rooted in a judicial decree should be labelled a mistake merely to circumvent the procedural rigour of approaching a civil court---Furthermore, the respondents' contention that a void decree was no decree and thus immune to limitation was contradicted by their own demand for execution of the same decree, thereby implicitly accepting its existence---Said dichotomy exposed a clear

failed to withstand scrutiny under the established legal framework---Complete absence of recourse to a civil court to challenge the decree stripped the revenue forum of any jurisdiction, as revenue courts exercise summary jurisdiction and lack competence to adjudicate questions of fraud, title or complex civil rights arising out of civil migationFrom an equitable standpoint, the conduct of the respondents also triggered the doctrines of acquiescence and estoppel---Parties who remain silent for prolonged periods and fail to challenge transactions in the proper forum forfeit the right to belatedly question long-standing revenue entries, especially when those entries flow from judicial determinations-Respondents' silence for over a decade rendered their belated challenge unsustainable---It is settled law that revenue authorities are creatures of statute and are confined strictly to the jurisdiction vested in them under the Punjab Land Revenue Act, 1967; they are not courts of plenary jurisdiction and cannot venture into questions that involve adjudication of civil rights, title or allegations of fraud, which require framing of issues and recording of evidence---Therefore, the District Collector is empowered to effect corrections in the revenue record only where the illegality or irregularity is manifest, apparent on the face of the record, and already established through a recognised legal or investigative process---Where the matter necessitates a detailed appraisal of evidence for determination of such questions, particularly in matters involving allegations or commission of fraud, the validity or competence under a General Power of Attorney, the enforceability of a decree, the requirement of execution of a decree or the applicability of limitation, the jurisdiction not only of the District Collector but of all revenue courts stands ousted---In such circumstances, revenue courts lack the lawful competence to venture into adjudication of such complex and inherently civil disputes---Therefore, the respondents had no lawful grounds to seek relief from the revenue courts in a matter which squarely fell within the domain of civil adjudication---Member-Judicial, Board of Revenue, Punjab upheld the order passed by the Additional Commissioner (Revenue), Lahore and, as a result, the earlier order passed by the Additional Deputy Commissioner (Revenue) stood set aside, and it was directed that the respondents may seek appropriate relief before a civil court of competent jurisdiction, if so desired---Review petition was accepted. (b) Punjab Land Revenue Act (XVII of 1967)---

the transfer effected thre S.53Specific Relief Act (I of 1877), S.42---Mutation entrie authority of---General Power of Attorney, validity of Civil coun based on civil court decree, challenge to-Revenue hierarcky, remedy---Scope Weight was lent to the petitioners' case by the validity of the decree and the General Power of Attorney---Such instruments can only be proceedings---In the present case, the Additional Commissioner, in challenged before a civil court and not by way of administrative his reasoned order, rightly appreciated the legal sanctity of the civil through a registered court decree, the bar of limitation and the jurisdictional limitations inherent in the revenue hierarchy; that order merited deference and not reversal---It was evident that the powers of attorney produced by the petitioners were valid, registered and covered the land in question---Mutation in question was sanctioned on the basis of said documents, which were duly verified before the transaction---The earlier order of Member-Judicial, Board of Revenue, Punjab had overlooked the documentary evidence and instead proceeded on a misapprehension of facts---Application of the respondents was not only delayed beyond the statutory limitation period but also involved disputed questions of title and allegations of fraud, which fell outside the jurisdiction of the revenue hierarchy---Member-Judicial, Board of Revenue, Punjab set aside the earlier order and upheld the order passed by the Additional Commissioner (Revenue), Lahore and, as a result, the earlier order passed by the Additional Deputy Commissioner (Revenue) stood set aside, and it was directed that the respondents may seek appropriate relief before a civil court of competent jurisdiction, if so desired---Review petition was accepted.
