پس منظرِ مقدمہ
یہ مقدمہ دعویٰ مہر اور نان و نفقہ سے متعلق تھا، جس میں رجسٹرڈ نکاح نامہ کی ثبوتی حیثیت اور حاشیہ شہداء کی عدم پیشی کے اثرات زیرِ غور آئے۔
رجسٹرڈ نکاح نامہ کی قانونی حیثیت
عدالت نے واضح کیا کہ رجسٹرڈ نکاح نامہ ایک مستند قانونی دستاویز ہے جس پر قانونِ شہادت کے تحت قرینۂ صحت لاگو ہوتا ہے، لہٰذا اس کی تکمیل مفروضہ طور پر ثابت سمجھی جاتی ہے۔
حاشیہ گواھان کی عدم پیشی کا اثر
یہ قرار دیا گیا کہ اگر میاں بیوی کا رشتہ تسلیم شدہ ہو تو نکاح نامہ کے حاشیہ شہداء کو پیش نہ کرنا دعویٰ مہر کے لیے مہلک نہیں بنتا۔
نکاح نامہ کی نقل اور شہادت
عدالت کے مطابق نکاح نامہ کی نقل پیش کیے جانے کی صورت میں اس کو ثابت کرنے کے لیے مزید گواہوں کی پیشی ضروری نہیں رہتی۔
زبانی انکار کی قانونی حیثیت
یہ بھی واضح کیا گیا کہ محض زبانی انکار، جو کسی تائیدی شہادت سے خالی ہو، قانوناً کوئی وزن نہیں رکھتا۔
حقِ مہر کا تعین
عدالت نے قرار دیا کہ نکاح ثابت ہو جانے کے بعد بیوی کا حقِ مہر قانونی طور پر قائم ہو جاتا ہے اور اس سے انکار کی کوئی گنجائش نہیں رہتی۔
نان و نفقہ سے متعلق عدالتی ذمہ داری
فیصلے میں اس امر کی نشاندہی کی گئی کہ نان و نفقہ کے فریم کردہ مسئلہ پر فیصلہ نہ دینا دائرۂ اختیار کے غلط استعمال کے مترادف ہے۔
نتیجہ اور عدالتی حکم
ہائی کورٹ کا حکم کالعدم قرار دے کر مقدمہ ازسرِنو فیصلے کے لیے ریمانڈ کیا گیا اور فریقین کو مکمل موقعِ سماعت فراہم کرنے کی ہدایت دی گئی۔

Muslim Family Laws Ordinance (VIII of 1961)-
S. 5-Qanun-e-Shahadat (10 of 1984), Art. 85-Family Courts Act (XXXV of XXV of 1964), 5. 5 & Sched.-Suit for recovery of of dower--Registered Nikah Nama-Evidentiary value-Scope-Marginal witnesses of Nikah Nama, non-production of---Effect-Claim of wife was declined on account of her failure to produce marginal witnesses of Nikah Nama-Held, that where the relationship of husband and wife is admitted and the execution of Nikah is not denied, then non-production of the marginal witnesses of the Nikah Nama before the Court is not fatal to the suit of the plaintiff/wife-In such circumstances, the execution of Nikah Nama stands proved and the plaintiff's entitlement to dower is established-Even, the copy of Nikah Nama having been produced did not require production of witnesses to prove it (Nikah Nama)-Mere verbal denial of the execution of Nikah Nama in the statement recorded before the Trial Court without supporting evidence carries no legal valu legal value---Nikah Nama is a document, which the Muslim Family Laws Ordinance, 1961, and as such such presumption of truth is attached to it carrying evidentiary value of Article 85 of the Qanun-e-Shahadat, 1984 In the present case, neither the Appellate Court nor the High Court had recorded any findings regarding issue framed by the Trial Court with respect to entitlement of plaintiff to recovery of maintenance allowance, thus, they failed to jurisdiction vested in them Supreme Court set aside the impugned order passed by the High Court, and remanded the case back to it (High Court) for decision afresh, after providing the parties an opportunity of hearing---Petition for leave to appeal was converted into an appeal and was allowed accordingly. unde under Section 5 of
