🧾 پس منظر:
محترمہ سیدہ کنیز حسن نے ڈپٹی کمشنر حافظ آباد کو درخواست دی کہ وہ محرم الحرام کی 1 تا 10 تاریخ خواتین کے لیے مجالسِ عزا منعقد کرنا چاہتی ہیں۔
تاہم، ڈپٹی کمشنر نے 15 جولائی 2023 کو یہ درخواست مسترد کر دی۔ وجہ یہ بتائی گئی کہ:
پٹیشنر کے پاس مجالس منعقد کرنے کا سابقہ ریکارڈ موجود نہیں۔
گزشتہ سال ایک مجلس کے انعقاد پر ان کے خلاف ایف آئی آر درج کی گئی تھی۔
⚖️ عدالتی کارروائی:
درخواست گزار نے اس فیصلے کے خلاف لاہور ہائی کورٹ میں آئینی درخواست (رٹ پٹیشن) دائر کی۔ عدالت نے معاملے کا جائزہ لیتے ہوئے اہم نکات پر روشنی ڈالی:
1. آرٹیکل 20 آئین پاکستان کا ایک بنیادی حق ہے، جو ہر شہری کو اپنے مذہب پر عمل، تبلیغ اور رسومات کی آزادی دیتا ہے۔
2. کوئی انتظامی پالیسی یا ہدایات بنیادی حقوق پر پابندی عائد نہیں کر سکتیں۔
3. عدالت نے یہ بھی واضح کیا کہ ڈپٹی کمشنر کا فیصلہ نہ تو کسی قانون، اور نہ ہی کسی واضح پالیسی پر مبنی تھا۔
4. عدالت نے یہ قرار دیا کہ پچھلی ایف آئی آر کی بنیاد پر شہری کو مذہبی رسومات سے نہیں روکا جا سکتا۔
✅ عدالتی فیصلہ:
عدالت نے ڈپٹی کمشنر کا فیصلہ کالعدم قرار دے دیا۔
پٹیشن کو منظور کر کے سیدہ کنیز حسن کو محرم کی مجالس منعقد کرنے کی اجازت دے دی۔
📌 اہم قانونی نکات:
مذہبی آزادی ناقابل تنسیخ آئینی حق ہے۔
کسی شخص کا ماضی میں مجالس منعقد نہ کرنا منع کا جواز نہیں بن سکتا۔
پالیسی یا ایف آئی آر کا حوالہ دے کر بنیادی حق سلب نہیں کیا جا سکتا۔
🔚 نتیجہ:
یہ فیصلہ اس بات کی واضح مثال ہے کہ عدالتیں شہریوں کے آئینی حقوق کی محافظ ہیں۔ اگر انتظامیہ کسی شہری کے بنیادی حق کو بغیر کسی قانونی بنیاد کے محدود کرے تو عدالت اس اقدام کو کالعدم قرار دینے کا مکمل اختیار رکھتی ہے۔

This writ petition calls into question order dated 15.072023 passed by the Deputy Commissioner, Hafizabad declining the request of the petitioner to hold Majlis-e-Aza (Women) from 1st to 10th of Mahram ul LEGAL DESK Leanien Assistant Advocate General sunits that there is no history of the petitioner of holding such Majalis. It is stated in fact last year the petitioner held a Majlis in respect of which an FIR was registered against her.
3. Learned Assistant Advocate General was asked to pinpoint the law which forbids the holding of Majlis but he was unable to refer to any such law. He, however, submits that a policy has been formulated by the Home Department which forbids holding of Majalis by the persons who have no past history of conducting such religious ceremonies.
4. Article 20 of the Constitution of the Islamic Republic of Pakistan, 1973 grants the right to every citizen to profess, practice and propagate his religion. This fundamental right cannot be abridged by a policy formulated by the Home Department. Even otherwise, the

impugned order does not refer to any policy of the Home Department, Government of Punjab. The impugned order also fails to furnish any lawful reason for declining the FOAL DESK ap licaton of th peti oner. in me circumstances, this writ petition is...llowed and order dated 15.07.2023 is set aside with the result that the petitioner shall be utied to hold Majlis-e-Aza (Women) from 1st to 10th of Mahram ul Haram.
