🔹 پس منظر:
یہ مقدمہ خیبرپختونخوا کے شہر مینگورہ سے تعلق رکھتا ہے، جہاں ناصر خان نامی شہری نے میونسپل کمیٹی کے خلاف سول عدالت میں مستقل حکم امتناعی (Permanent Injunction) کے لیے دعویٰ دائر کیا۔ دعوے کا مقصد ممکنہ غیرقانونی اقدامات یا تجاوزات کو روکنا تھا۔
🔹 میونسپل کمیٹی کا مؤقف:
میونسپل کمیٹی نے دعوے کے جواب میں مؤقف اختیار کیا کہ یہ معاملہ Khyber Pakhtunkhwa River Protection Ordinance, 2002 کے تحت آتا ہے، جس کی دفعات 13 اور 16 کے مطابق ایک خصوصی عدالت یا اتھارٹی کے قیام کا ذکر موجود ہے، لہٰذا سول عدالت کو یہ مقدمہ سننے کا اختیار نہیں۔
🔹 مقدمے کی کارروائی:
میونسپل کمیٹی نے CPC Order VII Rule 10
کے تحت دعویٰ واپس کرنے (return of plaint) کی درخواست دی، لیکن ٹرائل کورٹ نے یہ درخواست مسترد کر دی۔ بعدازاں اپیلٹ کورٹ نے کیس دوبارہ قانون کے مطابق کارروائی کے لیے واپس ٹرائل کورٹ کو بھجوا دیا۔
🔹 عدالت کا فیصلہ اور اصول:
عدالت نے قرار دیا کہ:
اس مقدمے میں
Order VII Rule 11 CPC
کا اطلاق نہیں ہوتا، کیونکہ معاملہ دعویٰ مسترد کرنے (rejection) سے متعلق نہیں بلکہ واپس کرنے (return) سے متعلق تھا۔
جس خصوصی عدالت کا حوالہ دیا گیا، وہ ابھی تک قائم نہیں ہوئی اور نہ ہی فعال ہے۔
ایسی صورت میں شہری کو انصاف کے لیے کسی بھی فورم سے محروم نہیں کیا جا سکتا۔
⚖️ اہم قانونی اصول:
عدالت نے فیصلہ دیا کہ:
❝ سول عدالت کو "تمام عدالتوں کی ماں" سمجھا جاتا ہے۔ جب تک کوئی مخصوص عدالت یا اتھارٹی باقاعدہ طور پر قائم اور فعال نہ ہو، محض کسی قانون میں اس کا ذکر ہونا سول عدالت کے دائرہ اختیار کو ختم نہیں کرتا۔ ❞
🔸 آئندہ کے لیے رہنمائی:
یہ فیصلہ اُن تمام معاملات میں ایک نظیر (precedent) کے طور پر کام کرے گا جہاں کوئی خصوصی قانون تو موجود ہو، لیکن اس کے تحت قائم کردہ عدالت یا اتھارٹی فعال نہ ہو۔ ایسی صورت میں شہری براہِ راست سول عدالت سے رجوع کر سکتا ہے۔

jurisdiction, but Trial Court rejected the same, and Appellate Court remanded the case for proceeding in accordance with law---Validity--- Provisions of O.
