(1) مقدمے کا پس منظر
(1) عدالت نے واضح کیا کہ اہم مقدمے (main lis) کا فیصلہ کرنے سے پہلے کسی بھی ضمنی یا غیر متعلقہ درخواست (miscellaneous application) کو فیصلہ کرنا لازمی ہے۔
(2) درخواست گزار نے انگوٹھوں کے نشانات (thumb impressions) کے موازنہ کے لیے ماہر کی رائے لینے کی درخواست دی تھی۔
(3) عدالت نے فیصلہ دیا کہ ضمنی درخواست کو نظر انداز کرتے ہوئے مقدمے کا فیصلہ کرنا جائز نہیں۔
(2) عدالت کا قانونی موقف
(1) عدالت یا فورم کے پاس اختیار ہے کہ وہ کسی پارٹی کی درخواست برائے ماہر کی رائے (expert opinion) منظور کرے یا مسترد کرے۔
(2) لیکن یہ اختیار یہ اجازت نہیں دیتا کہ ضمنی درخواست کو نظر انداز کرتے ہوئے اہم مقدمے کا فیصلہ کر لیا جائے۔
(3) غیر فیصلہ کرنے کی وجہ جو وکیل نے دی، وہ قابل قبول نہیں، کیونکہ عدالت کی ارادہ (intention) ماہر کی رائے لینے یا نہ لینے سے ظاہر ہوتی ہے۔
(3) قانونی اصول
(1) Order XIV CPC کے مطابق عدالت پر یہ فرض عائد ہوتا ہے کہ:
(a) پہلے فریقین کے درمیان تنازعہ کے نکات (points of dispute) طے کیے جائیں۔
(b) پھر ثبوت (evidence) ریکارڈ کرنے کی کارروائی کی جائے۔
(2) فریقین اپنے دعوے یا دفاع کے لیے ثبوت پیش کرتے ہیں، لیکن اگر کسی خاص نقطے پر کوئی مادی مسئلہ (material issue) نہ ہو تو یہ ماننا مشکل ہے کہ فریق جانتا تھا کہ کس تنازعے پر ثبوت پیش کرنا ہے۔
(4) عدالت کے احکامات
(1) اہم مقدمے سے پہلے تمام ضمنی اور غیر متعلقہ درخواستوں کا فیصلہ لازمی ہے۔
(2) عدالت نے واضح کیا کہ ماہر کی رائے حاصل کرنے کے اختیار کا غلط استعمال نہیں ہونا چاہیے۔
(3) ضمنی درخواست کے غیر فیصلہ کرنے کا جواز قابل قبول نہیں، اور یہ فرضی تصور کہ عدالت ماہر کی رائے لینے سے انکار کر رہی تھی، صحیح نہیں۔
(5) قانونی سبق
(1) عدالت کو تمام ضمنی درخواستوں (miscellaneous applications) کا فیصلہ کرنا لازمی ہے۔
(2) ماہر کی رائے حاصل کرنے کا اختیار صرف اس لیے ہے کہ ثبوت کی تصدیق کی جا سکے، لیکن اس اختیار کا غلط استعمال جائز نہیں۔
(3) فریقین کو صرف مادی نکات (material points/issues) کی بنیاد پر ثبوت پیش کرنے کی اجازت ہوتی ہے۔

It is well established by now that prior to deciding the main lis, a court or forum is bound to decide the miscellaneous application(s).
This Court is cognizant of the fact that it is optional for the Court either to accede to the request of a party for expert opinion in a matter or not but the said discretion cannot be used to permit a forum to decide the main case without taking decision on the miscellaneous application. Further, the justification given by the learned counsel for the respondents for non-decision of the application, filed by his clients for comparison of thumb impressions of the donors, does not appeal to reason inasmuch as the intention of the Court to permit or decline a party to get compared signatures/thumb impressions of a person on a document can be gathered from its order but inaction on its part to decide a miscellaneous application prior to decision in the main case, cannot be used to believe that the said forum was not willing to refer the matter for expert opinion.
Order XIV CPC casts heavy duty upon the court to firstly determine points of dispute between the parties and then to move for recording their evidence. It is of common knowledge that the parties are supposed to lead evidence to support or oppose a fact put before them in the shape of formal Issues but in absence of material Issue on a particular point, it cannot be believed that the party concerned was aware about the exact nature of the dispute regarding which he had to lead evidence.
