Interim Relief Denied in Property Dispute Over Agreement to Sell.



اس کیس میں عبوری ریلیف (Interim Relief) کی درخواست کی گئی تھی، جس پر فیصلہ دینے کے لئے عدالت نے "توازن کی حالت" (Balance of Convenience) کو مدنظر رکھا۔ اس سلسلے میں پاکستان کے آئین کے تحت اور مختلف قانونی اصولوں کے مطابق، عبوری ریلیف کا اطلاق اس صورت میں کیا جاتا ہے جب درخواست گزار یہ ثابت کرے کہ:

1. مقدمہ کا امکان:

 درخواست گزار کو یہ ثابت کرنا ضروری ہے کہ اس کا دعویٰ مضبوط ہے اور اس میں کوئی واضح قانونی دلیلی موجود ہے۔


2. توازن کی حالت: 

عدالت کو یہ دیکھنا ہوتا ہے کہ اگر عبوری ریلیف نہ دی جائے تو درخواست گزار کو زیادہ نقصان پہنچے گا یا مدعا علیہ کو۔ اس پر عدالت نے یہ فیصلہ کیا کہ مدعا علیہان کو زیادہ نقصان ہوگا، اس لئے عبوری ریلیف دینے سے انکار کیا گیا۔


3. ضرورت اور فوری کارروائی: 

عبوری ریلیف کی ضرورت اس صورت میں ہوتی ہے جب کسی فریق کو فوری طور پر نقصان سے بچانے کے لیے عدالت کی مداخلت ضروری ہو۔



پاکستان کے سول پروسیجر کوڈ (CPC) کی دفعات 94 اور 95 کے تحت، عبوری ریلیف عدالت کی صوابدید پر ہوتا ہے اور یہ صرف اُس صورت میں دیا جاتا ہے جب فریق کو اپنے حقوق کے تحفظ کے لیے فوری مدد کی ضرورت ہو۔

اس کیس میں عدالت نے درخواست گزار کو عبوری ریلیف دینے سے انکار کیا کیونکہ درخواست گزار کی ملکیت کے حق کو ابھی تک ثابت نہیں کیا جا سکا تھا اور توازن مدعا علیہ کے حق میں تھا۔

Where to establish a claim, evidence is required to be recorded, prima facie case cannot be assumed in favour of petitioner especially when he is yet to establish his right to hold possession of suit property or be transferred its ownership, which already vests in respondents, who are owners of the property, instead of petitioner, who is stated to be a tenant of respondents and his claim is based on mere agreement to sell which has been denied by the other side. Agreement to sell does not create any title but gives only a right to petitioner to claim specific performance of contract, if he can prove the said agreement as valid by refuting the claim of respondents that it was a forged and fabricated document. Besides, balance of convenience tilts in favour of respondents, owners of the property and not the petitioner, holder of disputed agreement to sell, as by grant of interim relief the respondents are likely to suffer more than what the petitioner would suffer if interim relief is refused.
