لاپتہ شخص کی وراثت: قانونی اور شرعی نقطۂ نظر
وراثت کا مسئلہ اسلامی فقہ اور ملکی قوانین میں ایک اہم حیثیت رکھتا ہے، خاص طور پر جب کوئی شخص لاپتہ ہو اور اس کی موت کی تصدیق نہ ہو سکے۔ اقبال علی خان بنام نسیب علی خان کیس میں ہائیکورٹ نے ایک اہم قانونی نقطہ واضح کیا ہے کہ لاپتہ شخص کی جائیداد اس کی گمشدگی کی تاریخ سے تقسیم نہیں ہوگی بلکہ اس کی موت کو قانونی طور پر تسلیم کیے جانے کی تاریخ سے وراثت کے اصول لاگو ہوں گے۔
اسلامی اور قانونی اصول
اسلامی فقہ، خاص طور پر حنفی قانون کے مطابق، لاپتہ شخص (مفقود الخبر) کو 90 سال کی عمر تک زندہ تصور کیا جاتا ہے، جب تک کہ اس کی موت کا ثبوت نہ مل جائے۔ تاہم، قانون شہادت 1984 کے آرٹیکل 123 اور 124 کے تحت:
- آرٹیکل 123 کہتا ہے کہ اگر کسی شخص کے زندہ ہونے کا ثبوت موجود ہو، تو اسے زندہ تصور کیا جائے گا، جب تک کہ اس کے برعکس شواہد پیش نہ کیے جائیں۔
- آرٹیکل 124 کے مطابق، اگر کوئی شخص سات سال تک لاپتہ رہے اور اس کی کوئی خبر نہ ہو، تو اسے مردہ تصور کیا جا سکتا ہے، بشرطیکہ اس کے زندہ ہونے کے کوئی شواہد موجود نہ ہوں۔
عدالتی فیصلہ اور اس کے اثرات
ہائیکورٹ نے اس کیس میں درج ذیل نکات واضح کیے:
- وراثت کا اطلاق اس وقت ہوگا جب لاپتہ شخص کو قانونی طور پر مردہ تسلیم کر لیا جائے، نہ کہ اس کی گمشدگی کے دن سے۔
- اگر کوئی شخص لاپتہ فرد کے مردہ تصور ہونے سے پہلے وفات پا جائے، تو وہ اس کی جائیداد کا وارث نہیں بن سکتا۔
- اگر موت کی کوئی مخصوص تاریخ ثابت نہ ہو سکے، تو عدالت یہ تصور کرے گی کہ لاپتہ شخص اسی تاریخ کو فوت ہوا جب مقدمہ دائر کیا گیا تھا۔
یہ فیصلہ وراثتی معاملات میں ایک اہم نظیر ثابت ہو سکتا ہے، کیونکہ یہ لاپتہ افراد کی جائیداد کے حوالے سے قانونی رہنمائی فراہم کرتا ہے اور ورثاء کے حقوق کا تعین آسان بناتا ہے۔

Under Islamic jurisprudence, the right to inherit property is contingent upon a person being legally recognised as deceased. Specifically, regarding a person categorised as missing, the rights to his inheritance are determined by the provisions that state that inheritance rights arise only from the date a person is presumed dead, not retroactively to the date of his disappearance. It is also important to highlight that any person who dies prior to the presumed death of the missing person is disqualified from inheriting his property.
Under Hanfi law, a person considered missing is presumed to be alive for up to ninety years from his date of birth.
Articles 123 and 124 of this Qanun-e-Shahadat are particularly pertinent to the matter at hand. Article 123 maintains that when a state of things is demonstrated to exist, there is a legal presumption regarding its continuity, reflective of the typical duration of such a state of things. It specifies that if evidence shows a person was alive within thirty years prior to the date when the question of his status arises, there is a presumption that he is still alive. The burden of proof then falls upon the party asserting his death. However, this presumption is susceptible to rebuttal under Article 124, which states that if it can be demonstrated that such a person has not been heard of for a period of seven years by those who would naturally have maintained contact with him, the burden of proof then shifts to those claiming the person is still alive.
When there is a dispute in a case regarding the date of death of a person who has not been heard from by their relatives for more than seven years, the burden of proof lies with those who assert a specific date. They must provide affirmative evidence to support their claim. However, if no one can demonstrate a particular date or year, the Court should presume that the person was deceased as of the date the suit was instituted rather than at any earlier date
