1. اختیارات کا دائرہ (S.172(2)(viii))

بلوچستان لینڈ ریونیو ایکٹ کے تحت، ریونیو حکام صرف خلاصہ نوعیت کے مقدمات نمٹانے کے مجاز ہی

پراپرٹی کی ملکیت یا عنوان سے متعلق پیچیدہ اور متنازعہ سوالات کو ریونیو حکام کے ذریعے حل نہیں کیا جا سکتا۔

2. ملکیت کا تنازعہ

مقدمہ ایک پراپرٹی کے حوالے سے تھا، جو موبائل ٹاور کی تنصیب کے لیے لیز پر دی گئی تھی۔

پراپرٹی کی ملکیت کے سوال اور دھوکہ دہی کے الزام کو ریونیو حکام کے دائرہ اختیار میں حل نہیں کیا جا سکتا۔

3. سول عدالت کا دائرہ اختیار

سول عدالت کو مکمل دائرہ اختیار حاصل ہے تاکہ ملکیت کے سوالات اور قانونی تنازعات کو حل کر سکے۔

ریونیو حکام کی کارروائی، جو خلاصہ نوعیت کی ہوتی ہے، ایسے متنازعہ معاملات کا فیصلہ نہیں کر سکتی۔

فریقین کو ایسے معاملات میں سول عدالت سے رجوع کرنا چاہیے۔

4. ایڈیشنل کمشنر کے فیصلے کی قانونی حیثیت

اسسٹنٹ کمشنر کا حکم غیر قانونی قرار دیا گیا کیونکہ وہ ریونیو ایکٹ کی لازمی دفعات کی خلاف ورزی پر مبنی تھا۔

عدالت نے اس حکم کو کالعدم قرار دیا۔

5. ملکیت کے سوال کی وضاحت

"ملکیت کا سوال" کسی شخص کے دعوے کو بیان کرتا ہے کہ وہ کسی پراپرٹی کا مالک ہے۔

یہ سوال اس وقت پیدا ہوتا ہے جب کوئی دوسرا شخص اس کے حق یا دلچسپی کو چیلنج کرے۔

----S.172(2)(viii)---Civil Procedure Code (V of 1908), S.9---Dispute regarding ownership of property leased out for installation of a cell phone Tower---Allegation of fraud---Factual/disputed questions qua title, resolution of---Plenary jurisdiction of Civil Court---Scope---Civil Court is a Court of plenary jurisdiction and disputed question of facts and law regarding the title of the disputed property cannot be decided by the revenue authorities, proceedings before whom are summary in nature---In such like cases, the parties ought to approach the Civil Courts---Order passed by Assistant Commissioner was not sustainable in the eye of the law, having been passed in utter violation of the mandatory provision of the Revenue Act and the same was set aside---Constitutional petition was allowed accordingly.
