مقدمہ کا پس منظر:

یہ مقدمہ کیپیٹل ڈیولپمنٹ اتھارٹی (CDA) کی جانب سے ماسٹر پلان کے تحت بعض پلاٹس کی الاٹمنٹ سے متعلق تھا، جسے اسلام آباد ہائیکورٹ نے غیر قانونی قرار دیتے ہوئے منسوخ کر دیا تھا۔

ہائی کورٹ کا فیصلہ:

اسلام آباد ہائیکورٹ نے قرار دیا کہ CDA نے ماسٹر پلان میں غیر قانونی تبدیلی کر کے بند گلی (Closed End Street) میں نئے پلاٹس تخلیق کیے، لہٰذا نہ صرف پلاٹس منسوخ کیے گئے بلکہ ذمہ دار افسران کے خلاف محکمانہ کارروائی کا بھی حکم دیا گیا۔

سپریم کورٹ میں بنیادی سوال:

کیا وہ زمین جو ماسٹر پلان میں “Future Use” کے لیے مختص ہو، اس پر پلاٹس الاٹ کیے جا سکتے ہیں یا نہیں؟
سپریم کورٹ کا قانونی تجزیہ:
سپریم کورٹ نے واضح کیا کہ “Future Use” سے مراد یہ نہیں کہ زمین ہمیشہ خالی رکھی جائے یا صرف عوامی سہولیات (Amenities) کے لیے مخصوص ہو۔
عدالت نے ماسٹر پلان، لے آؤٹ پلان اور گوگل میپ ڈیٹا کا جائزہ لے کر قرار دیا کہ متنازعہ پلاٹس کی جگہ واضح طور پر موجود تھی اور ان سے کسی بھی فریق کی روشنی، ہوا یا دیگر قانونی حقوق متاثر نہیں ہو رہے تھے۔

حقوق کی خلاف ورزی کا فقدان:

عدالت نے مشاہدہ کیا کہ درخواست گزار یہ ثابت کرنے میں ناکام رہے کہ پلاٹس کی الاٹمنٹ سے ان کے کون سے مخصوص قانونی حقوق متاثر ہوئے، یا ایسا کون سا قانون موجود ہے جو “Future Use” زمین کے استعمال کو روکتا ہو۔

CDA کے اختیارات:

سپریم کورٹ نے قرار دیا کہ CDA کو یہ اختیار حاصل ہے کہ وہ ماسٹر پلان کے دائرہ کار میں رہتے ہوئے، پہلے سے موجود الاٹیز کے فائدے کے لیے “Future Use” کے لیے مختص زمین کو استعمال میں لا سکے۔

حتمی فیصلہ:

سپریم کورٹ نے ہائی کورٹ کے فیصلے کالعدم قرار دیتے ہوئے
پلاٹس کی منسوخی ختم کر دی
اور تمام الاٹمنٹس بحال کر دیں۔

قانونی اہمیت:

یہ فیصلہ اس اصول کو واضح کرتا ہے کہ
“Future Use” زمین کو لازمی طور پر کھلا یا غیر استعمال شدہ رکھنا ضروری نہیں،
اور جب تک کسی قانون یا حقوق کی خلاف ورزی ثابت نہ ہو،
ڈیولپمنٹ اتھارٹی ایسی زمین کو الاٹ کر سکتی ہے۔

Allotment---

----Legality---Master Plan---Land designated on the Master Plan for "Future Use"---Connotation---Writ petitions were filed before the High Court alleging that the Capital Development had illegally and unlawfully changed the Master Plan and created certain new plots in a closed end street, which the CDA could not do so and that it be restrained from approving the building plans in respect of the said plots and be directed to adhere to the Master Plan---High Court allowed the said petitions, cancelled the said plots, and further directed CDA to initiate departmental action against those who had violated the Master Plan---Validity---Counsel for respondents (petitioners before the High Court) was not able to point out any legal restriction preventing the plots in question from being allotted, particularly when the said land was designated on the Master Plan for Future Use---Master Plan, the layout plans and Google map data which had been filed showed the location of the said plots, and there was no question of obstruction of light and air with respect to the plots of the respondents---Counsel for respondents could not show what particular rights of theirs had been violated in allotting the said plots nor did he refer to any law which prevented CDA from utilizing, for the benefit of earlier allottees, land designated for 'Future Use'---Term 'Future Use' did not mean that the land was to be left open nor did it mean that it was to be used for amenity purposes, which may, have prohibited their allotment---Petitions were converted into appeals and allowed, impugned judgments of the High Court were set-aside and the cancelled allotments were restored.
