غلط فورم پر اپیل دائر کرنے سے تاخیر معاف نہیں ہوتی
تعارف
لاہور ہائیکورٹ نے اس فیصلے میں مدتِ معیاد کی پابندی کی اہمیت واضح کرتے ہوئے قرار دیا کہ قانونی تقاضوں کی پابندی محض تکنیکی امر نہیں بلکہ انصاف کے نظام کی بنیاد ہے۔ غلط فورم پر رجوع کرنے میں صرف کیا گیا وقت بلاجواز طور پر خارج نہیں کیا جا سکتا۔
مقدمے کے حقائق
مدعی کا دعویٰ سول کورٹ سے خارج ہو گیا۔ اس کے بعد مدعی نے ہائیکورٹ میں اپیل دائر کرنے کے بجائے ضلعی عدالت میں اپیل دائر کر دی، جو تقریباً ایک سال تک زیرِ التوا رہی۔ بالآخر ضلعی عدالت نے اس اپیل کو ضابطۂ دیوانی کے تحت واپس کر دیا۔ بعد ازاں مدعی نے ہائیکورٹ میں اپیل دائر کرتے ہوئے یہ استدعا کی کہ ضلعی عدالت میں گزارا گیا وقت مدتِ معیاد سے خارج کیا جائے۔
مدعی کا مؤقف
مدعی کا مؤقف تھا کہ مقدمات کا فیصلہ تکنیکی بنیادوں کے بجائے میرٹ پر ہونا چاہیے، اس لیے غلط فورم پر اپیل دائر کرنے میں صرف ہونے والا وقت خارج کیا جانا چاہیے اور تاخیر معاف کی جائے۔
عدالت کی قانونی رائے
عدالت نے قرار دیا کہ مقررہ مدت کے اندر درست فورم سے رجوع کرنا محض ایک تکنیکی تقاضا نہیں بلکہ قانون کی بنیادی شرط ہے۔ قانونِ معیاد کا مقصد لاپرواہی، عدم احتیاط یا عدم چوکسی کی حوصلہ افزائی کرنا نہیں۔ دفعہ پانچ یا دفعہ چودہ قانونِ معیاد کا اطلاق اس صورت میں نہیں ہو سکتا جہاں فریق اپنی کوتاہی کا خود ذمہ دار ہو۔
فیصلہ
عدالت نے یہ قرار دیا کہ غلط فورم پر تقریباً ایک سال تک اپیل چلانے کی بنیاد پر مدتِ معیاد خارج کرنے کی درخواست میں کوئی وزن نہیں۔ چنانچہ وقت میں توسیع اور تاخیر معافی کی درخواست مسترد کر دی گئی۔
قانونی اہمیت
یہ فیصلہ اس اصول کو مضبوط کرتا ہے کہ فریقین پر لازم ہے کہ وہ بروقت اور درست فورم سے رجوع کریں۔ قانونِ معیاد کو لاپرواہی کے ازالے کے لیے استعمال نہیں کیا جا سکتا اور انصاف تک رسائی کے لیے قانونی حدود کی پابندی ناگزیر ہے۔

Application for enlargement of time by excluding the time period of pursuing the case before wrong forum / Court --- Condonation of delay --- " Sufficient cause " --- Suit instituted by the plaintiff ( appellant ) was dismissed by the Civil Court , however , Instead of filing appeal before the High Court , he filed appeal before the District Court which remained pending for about one year and finally the appeal was returned under O.VII , R.10 of the C.P.C .--- Appellant / plaintiff while preferring appeal before the High / Appellate Court also moved an application for excluding the period of pursing the remedy before the District Court --- Contention of the applicant / appellant that the cases should be decided on the basis of merits rather than technicalities --- Held , that the contention of the applicant / appellant was misconceived as availing the remedy within the period provided by law was not merely a technicality --- Section 5 or S.14 of the Limitation Act , 1908 , was not intended to add premium to the carelessness or to validate lack of vigilance and required caution by a litigant --- Application for enlargement of time by excluding the time period of about one year for pursuing remedy before wrong forum , filed by the appellant , had no substance , therefosre , the same was dismissed.
