خلاصہ:
سپریم کورٹ آف پاکستان نے اپنے حالیہ فیصلہ PLD 2025 SC 371 میں ایک اہم اصول کی وضاحت کی ہے کہ اگر کوئی اپیل غلط فورم میں دائر کی جائے تو اس پر ضائع ہونے والا وقت تاخیر کی معافی کے زمرے میں نہیں آتا، خواہ اپیل کنندہ ایک ریاستی ادارہ ہی کیوں نہ ہو۔
پسِ منظر:
ایک ریاستی ادارہ ٹرائل کورٹ کے اُس فیصلے سے ناخوش تھا جس میں ایک ایوارڈ کو عدالتی ڈگری (rule of the court) بنایا گیا تھا۔ اس ادارے نے اپیل براہِ راست ہائی کورٹ میں دائر کی، جہاں وہ اپیل مالیاتی دائرہ اختیار نہ ہونے کی وجہ سے خارج کر دی گئی۔ بعد ازاں متعلقہ زیریں عدالت میں اپیل دائر کی گئی، مگر وہ تقریباً دو سال بعد دائر ہوئی، جس پر تاخیر کی معافی کی درخواست دی گئی۔
سپریم کورٹ کا فیصلہ:
سپریم کورٹ نے درج ذیل نکات پر فیصلہ صادر فرمایا:
قانونِ معیاد (Limitation Act 1908) کی دفعہ 5 کے تحت تاخیر صرف تبھی معاف ہو سکتی ہے جب ہر دن کی تاخیر کی واضح، معقول اور قابل قبول وضاحت دی جائے۔
غلط فورم (wrong appellate forum) میں اپیل دائر کرنا بذاتِ خود تاخیر کا معقول جواز نہیں بنتا۔
ریاستی ادارے بھی قانون کی نظر میں عام سائل کے برابر ہیں اور انہیں کوئی خصوصی رعایت حاصل نہیں۔
دفعہ 14 اور دیگر دفعات اسی وقت لاگو ہوں گی جب سائل نیک نیتی اور مستعدی سے مقدمہ چلا رہا ہو۔
West Pakistan Civil Courts Ordinance, 1962 کی دفعہ 18 کے تحت اپیل کا درست فورم مالیاتی دائرہ اختیار سے متعین ہوتا ہے، جس میں کسی ابہام کی گنجائش نہیں۔
نتیجہ:
عدالت نے ریاستی ادارے کی طرف سے دائر کردہ اپیل کو نا قابلِ سماعت قرار دیتے ہوئے خارج کر دیا اور تاخیر کی معافی کی درخواست کو مسترد کر دیا۔

قانونی اہمیت:
یہ فیصلہ اس بات کی نظیر ہے کہ ریاستی ادارے بھی قانون کی پابندی سے مستثنیٰ نہیں۔ سپریم کورٹ نے واضح کیا ہے کہ غلط فورم میں اپیل دائر کرنا نیک نیتی یا مستعدی کے زمرے میں نہیں آتا، اور سائل کو ہر دن کی تاخیر کے لیے تسلی بخش وضاحت دینا لازم ہے۔

Condonation of delay---Wrong appellate forum---Petitioner/authorities were aggrieved of award being made rule of the Court, and preferred appeal before High Court but the same was dismissed for lack of pecuniary jurisdiction---Lower Appellate Court and High Court declined to condone the delay caused due to filing of appeal before High Court---Validity---Delay of time in filing of appeal, application or suit may be condoned but subject to plausible and reasonable explanation---One who seeks condonation of delay has to explain each and every day's delay---Petitioner/authorities could not put-forward reasonable and plausible justification/explanation for filing ppeal after about two years of passing of judgment and decree by Trial Court---Earlier appeal filed before High Court was not reasonable justification---Petitioner/ authorities could not claim to be treated in any manner differently from an ordinary litigant---Time consumed in pursuing appeal in wrong forum buld not be condoned under section 5 of Limitation Act, 908---Time spent in pursuing proceedings before wrong appellate forum could not be excluded for the purposes of filing an appeal---If appeal was barred by time, provisions of ection 5 of Limitation Act, 1908, could only be invoked, that bo, by showing sufficient cause---Forum of appeal was regulated by jurisdictional value in plaint---In presence of section 18 of West Pakistan Civil Courts Ordinance, 1962 there could be no doubt or complication to determine forum of apeal---Provisions of sections 5 and 14 of Limitation Act, 1908 ould come into play only if delay appeared to be condonable cause of the petitioners/authorities prosecuting their case with due diligence
