یہ حوالہ (Citation) 2025 SCMR 64 سپریم کورٹ کا ایک فیصلہ ہے جو معاہدہ بیع (Agreement to Sell) کی مخصوص کارکردگی (Specific Performance) کے دعوے سے متعلق ہے۔

خلاصہ:

یہ فیصلہ دفعہ 22 سے متعلق ہے اور اس میں کہا گیا ہے کہ مخصوص کارکردگی کا حکم دینا عدالت کی صوابدیدی (discretionary) طاقت میں آتا ہے۔ اگر عدالت سمجھے کہ حکم دینے سے انصاف اور مساوات (equity) مدعی (Plaintiff) کے حق میں ہے تو وہ حکم دے سکتی ہے، ورنہ وہ اسے مسترد بھی کر سکتی ہے۔ یہاں تک کہ اگر مدعی معاہدہ بیع کو ثابت بھی کر دے، تب بھی عدالت کے پاس اختیار ہے کہ وہ مخصوص کارکردگی کا حکم دے یا نہ دے۔

اہم نکات:

  1. مخصوص کارکردگی کا حکم عدالت کی صوابدید پر منحصر ہے۔
  2. اگر عدالت محسوس کرے کہ انصاف اور مساوات مدعی کے حق میں ہے، تو حکم جاری کیا جا سکتا ہے۔
  3. محض معاہدہ بیع کا ثبوت فراہم کر دینا کافی نہیں، بلکہ عدالت کے صوابدیدی اختیار کا کردار بھی اہم ہے۔

یہ فیصلہ ان مقدمات میں مددگار ثابت ہو سکتا ہے جہاں مخصوص کارکردگی کے دعوے میں عدالت کے اختیار اور صوابدیدی طاقت کو چیلنج کیا جا رہا ہو۔

S. 22---Suit for specific performance of agreement to sell---Discretion of Court---Scope---In a suit for specific performance grant of decree is a discretionary relief with the court---If the court comes to the conclusion that in grant of a decree equity leans in favour of the plaintiff then decree can be granted, otherwise, it is the discretion of the court---Even if the plaintiff has proved the agreement to sell even then it is the discretion of the court to grant a decree or refuse the same.
