یہ قانونی نکتہ واضح کرتا ہے کہ تعزیراتِ پاکستان (Cr.P.C) کی دفعہ 265-F کے تحت استغاثہ کے گواہوں کی شہادت قلمبند کرنے کا باقاعدہ طریقہ کار موجود ہے۔ اس دفعہ میں کہیں بھی یہ پابندی عائد نہیں کی گئی کہ عدالت صرف ان گواہوں کی شہادت قلمبند کرے گی جن کے بیانات پولیس نے دفعہ 161 کے تحت ریکارڈ کیے ہوں۔
اگر کوئی گواہ وقوعہ کے دوران زخمی ہوا ہو اور اس کا نام گواہوں کی فہرست میں شامل ہو، تو اس کی شہادت کو محض اس بنیاد پر مسترد نہیں کیا جا سکتا کہ تفتیشی افسر نے جان بوجھ کر یا کسی غفلت کے باعث اس کا بیان دفعہ 161 Cr.P.C کے تحت ریکارڈ نہیں کیا۔ خاص طور پر جب میڈیکل افسر نے اس کی چوٹوں کو حقیقی قرار دیا ہو اور ان کے جعلی ہونے کے امکان کو رد کر دیا ہو، تو ایسا گواہ واقعات کا سب سے زیادہ باخبر فرد ہوتا ہے، اور اس کی گواہی کو نظرانداز نہیں کیا جا سکتا۔
یہ اصول عدالتِ عالیہ کے فیصلے Criminal Appeal No. 78896/2019، محمد احسان عرف ملکّو بنام ریاست (2025 PCr.LJ 334) میں طے پایا، جس میں گواہ کی گواہی کو محض تفتیشی افسر کی غفلت یا بدنیتی کی بنا پر مسترد کرنے کی اجازت نہیں دی گئی۔
A proper procedure for recording of prosecution evidence, after framing of charge has been laid down in Section 265-F of Cr.P.C. Nowhere in the said section a prohibition has been contained that the Court is bound only to record the testimony of a person, whose statement U/S 161 Cr.P.C. was recorded by the police.
Witness sustained injury during the occurrence and even his name was reflecting in the calendar of witnesses. The Medical Officer who conducted his medico legal examination ruled out any possibility of fabrication qua the injury sustained by him, therefore, none else is more aware of the facts than the said witness and his testimony cannot be excluded merely for the reasons that the Investigating Officer due to negligence or with malafide intention did not record his statement U/S 161 Cr.P.C.
